SECTION I. The Common Council hereby reconfirms and hereby ratifies its Declaratory and <br />Confirmatory Resolutions, as amended, designating the area described as 3152 Mary Court as <br />an Economic Revitalization Area for the purposes of tax abatement. Such designation is for <br />Real property tax abatement only and is limited to two (2) calendar years from the date of <br />adoption of the Declaratory Resolution by the Common Council. <br />SECTION II. The Common Council hereby determines that the property owner is qualified <br />for and is granted Real property tax deduction for a period of ten (10) years, and further <br />determines that the petition substantially complies with Chapter 2, Article 6, of the Municipal <br />Code of the City of South Bend and Indiana Code 6- 1.1 -12 et sea. <br />SECTION III. The Common Council pursuant to Section 2 -84 of the South Bend Municipal <br />Code finds the ten (10) years is the appropriate and rational time period for this tax abatement <br />in light of the following: <br />The petitioner was asked by the City of South Bend to relocate his business to <br />accommodate the TJX Company's new warehouse distribution center. <br />The petitioner was most cooperative and fair in his dealings with all involved in <br />the TJX Company project. <br />The petitioner also facilitated the site clearing process by relocating equipment <br />on his property prior to the date at which his property was to be transferred. <br />The petitioner did all of this without knowing exactly how or where he would <br />continue operations. <br />SECTION IV. The Council further exercises its authority pursuant to Indiana Code 6-1.1 - <br />12.1-11.3(c) and waives certain compliance requirements with such waiver taking place after <br />public hearing. The Council further finds that each of the additional findings required pursuant <br />to Indiana Code 6 -1.1- 12.1 -4.5 have been met, and that JVH's property at 3152 Mary Court <br />is declared an Economic Revitalization Area. <br />SECTION V.
