A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY
FOR THE PROVISION OF SERVICES TO AN ANNEXATION AREA IN
GERMAN TOWNSHIP
(MAHLER/STIDHAM ANNEXATION AREA)
WHEREAS, there has been submitted to the Common Council of the City of South Bend,
Indiana, an Ordinance and a petition by the sole (100 %) property owner which proposes the
annexation of real estate located in German Township, St. Joseph County, Indiana, which is
described more particularly in Section I of this Resolution, and;
WHEREAS, the territory proposed to be annexed encompasses approximately 18.40 acres
of land containing two family homes, which property is at least 12.5% contiguous to the current City
limits, i.e., approximately 44% contiguous, generally located on both the north and south sides of
Cleveland Road, approximately 600 feet west ofthe St. Joseph Valley Parkway. It is anticipated that
in the future the annexation area may be developed as either commercial or industrial based on
surrounding land uses which will require a basic level of municipal public services of a non - capital
improvement nature, including police and fire protection, street and road maintenance, street
sweeping, flushing, snow removal, and sewage collection, as well as services of a capital
improvement nature, including street and road construction, street lighting, a sanitary sewer system,
a water distribution system and a storm water system; and
WHEREAS, the Common Council of the City of South Bend, Indiana, now desires to
establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of
services of a non - capital nature, including street and road maintenance, sewage collection, street
sweeping, flushing, and snow removal, police and fire protection, and other non - capital services
normally provided within the corporate boundaries, and services of a capital improvement nature,
including street and road construction, street lighting, a sanitary sewer extension, a water
distribution system, and a storm water system to be furnished to the territory to be annexed; (2) the
method(s) of financing those services; (3) the plan for the organization and extension of those
services; (4) that services of a non - capital nature will be provided to the annexed area within one (1)
year after the effective date of the annexation, and that they will be provided in a manner in standard
and scope to similar non - capital services provided to areas within the corporate boundaries of the
City of South Bend, regardless of similar topography, patterns of land use, or population density; (5)
that the services of a capital improvement nature will be provided to the annexed area within four
(4) years after the effective date of the annexation in the same manner as the services are provided
to areas within the corporate boundaries of the City of South Bend, regardless of similar topography,
patterns of land use, or population density, and in a manner consistent with federal, state and local
laws; and (6) the plan for hiring the employees of other governmental entities whose jobs will be
eliminated by the proposed annexation; and
WHEREAS, the Board of Public Works of the City of South Bend, and the Board of Public
Safety of the City of South Bend, have each approved a written Fiscal Plan and established a policy
for the provision of services to the territory proposed to be annexed, which plan and policy the
Common Council finds to be appropriate and in the best interest of the City, and, which it desires
to adopt.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. It is in the best interest of the City of South Bend and the area proposed to be
annexed that the real property located in German Township, St. Joseph County, Indiana, described
more particularly as follows, be annexed to the City of South Bend:
A PART OF THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER
OF SEC 19, TOWNSHIP 38 NORTH, RANGE 2 EAST; A PART OF THE
NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 30,
TOWNSHIP 38 NORTH, RANGE 2 EAST, ALL IN GERMAN TOWNSHIP, ST.
JOSEPH COUNTY, INDIANA, BEING MORE PARTICULARLY DESCRIBED
AS FOLLOWS:
BEGINNING AT THE SOUTHEAST CORNER OF THE OLIVE ROAD
COMMERCE PARK, SECTION 2; THENCE SOUTH ALONG THE CITY OF
SOUTH BEND CORPORATE LIMITS TO THE NORTHEAST CORNER OF LOT
1 OF MILLER -OWENS MINOR SUBDIVISION; THENCE WEST ALONG THE

Section II. It shall be and hereby is now declared and established that it is the policy of the
City of South Bend, to furnish services to said territory of a non - capital nature, such as police and
fire protection, street and road maintenance, sewage collection, street sweeping, flushing, and snow
removal, within one (1) year of the effective date of the annexation, in a manner equivalent in
standard and scope to the services furnished by the City to other areas of the City regardless of
similar topography, patterns of land use, or population density; and to furnish to said territory
services of a capital improvement nature, such as street and road construction, street lighting, a
sanitary sewer extension, a water distribution system, and a storm water system, within four (4) years
of the effective date of the annexation in the same manner as those services are provided to areas
within the corporate boundaries of the City of South Bend regardless of similar topography, patterns
of land use, or population density, and in a manner consistent with federal, state and local laws,
procedures, and planning criteria.
Section III. The Common Council for the City of South Bend shall and does hereby now
establish and adopt The Fiscal Plan as set forth in Exhibit "A ", attached hereto and made a part
hereof, for the furnishing of said services to the territory to be annexed, which Fiscal Plan provides
among other things, that sanitary sewer mains are currently in place and available to service this
annexation area; that a water main line on the south side of Cleveland Road will be sufficient to
service this area; that any extensions of water and sewer main lines will be paid from Airport
Economic Development Area TIF; that improvements will be made to Cleveland Road (which will
be called Nimtz Parkway upon annexation), the cost of which improvements will be paid out of the
Airport Economic Development Area TIF; that any appropriate street lighting will be paid out of the
Airport Economic Development Area TIF; and that an approved drainage plan will be required with
any improvements to Cleveland Road.
Section IV. This Resolution shall be in full force and effect from and of its date of adoption
by the Common Council and approval by the Mayor

SECTION I. INTRODUCTION
A. General
This Fiscal Plan represents the City of South Bend's (hereinafter, "City") policy for the annexation
of property in German Township, St. Joseph County, Indiana (hereinafter, "Annexation Area "),
and was developed through the cooperative efforts of the Area Plan Commission and the following
City Departments:

SECTION II.. GENERAL DATA
A. Location
The Annexation Area is located on both the north and south sides of Cleveland Road,
approximately 600 feet west of the St. Joseph Valley Freeway. See Map L
B. Legal Description
The Annexation Area is part of the Southeast Quarter of the Southwest Quarter of Sec 19,
Township 38 North, Range 2 East; a part of the Northeast Quarter of the Northwest Quarter of
Section 30, Township 38 North, Range 2 East, all in German Township, St. Joseph County,
Indiana. For a complete legal description see Table 2.
C. Contiguity
The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City limits:

D. Size of Annexation Area
The Annexation Area is approximately 18.40 acres in area.
E. Buildings and Land Use

There are two houses in the Annexation Area, one for each of the two properties. There are no
immediate development plans, but it is anticipated that the properties will be developed as either
commercial or industrial, based on the surrounding land uses. The most immediate need is that the
purchase of the properties by the City of South Bend will be to widen and improve Cleveland
Road.
F. Zoning & Subdivisions
The site is zoned "A" Agricultural and "M" Manufacturing in unincorporated St. Joseph County.
It is proposed to be zoned "A" Single Family upon incorporation.
G. Population
There are two families currently residing in the Annexation Area.
H. Tax Rate
The tax rates used are those of 2001 payable in 2002.
The Township Rate will decrease by $.1908 per $100.00 of assessed valuation with the deletion of
the Fire Fighting Fund, the Fire debt Fund and the Cumulative Fire assessments.
The tax rate for the Annexation Area will increase by $2.8726 with the addition of the City and
Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate.
The net increase in property taxes will be $2.6818 per $100.00 of assessed valuation. Table 1
shows representative tax rate information as published by the St. Joseph County Auditor.

J. Municipal Legislative District
The Annexation Area will be in the 1st District.

K Hiring Plan
It is anticipated that this annexation will not result in the elimination of jobs for employees of any
other governmental entities. The German Township Trustee has been notified of this annexation.
SECTION III. MUNICIPAL SERVICES
A. Public Works
Sewer - The sanitary sewer mains are currently in place and available to service the area
No additional expenditures will be needed to extend existing sewer main facilities.
Water - There is currently a 12" water main on the south side of Cleveland Road. This main will
provide more than adequate water capacity for the Annexation Area. A flow test taken at Olive and
Cleveland Roads on July 26, 2000 indicated a static pressure of 55 psi, residual pressure of 44 psi,
and a flow rate of 1048 gpm.
No additional expenditures will be needed to extend existing water main facilities.
Street Lighting - Street lighting, if provided, will be paid out of the Airport Economic
Development Area TIF. Once installed, the maintenance and utility bill are paid by the City at a
cost of approximately $13 per light per month. No determination as been made at this time on the
number of street lights that will be required. For purposes of determining an approximate cost, the
installation of 3 lights is assumed, but final count is to be determined at time of Public works
approval of the engineering and construction drawings.
3 x 13 = $39.00 per month x 12 = $468.00 per year x 5 years = $2,340.00
Waivers of Annexation - No waivers of the right to remonstrate against an annexation are in effect
for this area.
Streets - The Department of Community and Economic Development has programmed
improvements on Cleveland Road, which will be called Nimtz Parkway upon annexation.
Improvements will be paid out of the Airport Economic Development Area TIF. Upon
annexation, this portion of Cleveland Road will add mileage to the roadway inventory. The new
mileage will increase distributions to the City's Motor Vehicle Highway Fund and Local Road and
Street Account sufficient for street maintenance, sweeping, and snow removal.
Drainage Plan - Any improvements to Cleveland Road will require an approved drainage plan.
The Sewer Maintenance Bureau will maintain the storm water system with revenues from
wastewater collection and treatment.

When fully developed, this annexation area is not expected to require major capital outlays for
public works vehicles or equipment.
Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2,
I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer
Utility.
B. Police Department
The noted area would be expected to be added to the already existing Beat 22. Police patrols,
traffic enforcement, and emergency responses will be part of the services the City will offer to this
area. At this time it is not expected that this annexation would cause calls for service to increase
significantly and it is not anticipated that it will be necessary to increase police patrols beyond the
already existing beat patrol at this time. The area under consideration is not expected to cause any
unusual problems. Cost for servicing this area would be expected to be absorbed by the existing
budget of the Police Department, as the addition of this area would not be significant to the point
of having to increase any budgetary items. Police services and response time in this area can be
expected to be comparable and consistent with that as in all other areas of the City. Police
coverage to this area could begin immediately upon annexation and coordination of the conversion
of the 911 emergency phone system for that area.

C. Fire Department
The Annexation Area will be serviced primarily by Station #11, located at 3505 North Bendix
Drive approximately three point two (3.1) miles away. Additional Fire Department units would
respond from Fire Station 97 located at 1616 Portage Avenue which is approximately five point
seven (5.4) miles away.
The South Bend Fire Department does not foresee any unusual fire protection problems related to
this annexation. Response times will be comparable to other areas of the City. No additional
equipment will need to be purchased or personnel hired to service the Annexation Area. Adequate
water supply will be necessary as development takes place. It is not anticipated that the services of
this Department will be required to a great extent in the early years of the development of this
area, although monitoring will still be conducted. Therefore, the service cost of the Department

Area in the first five years.

D. Code Enforcement
The Annexation Area will be added to Territory 8
The Department of Code Enforcement will be able to provide services to the Annexation Area
with comparable response times. The Department will respond to calls for service upon the
effective date of the Annexation. Full and dedicated response will be in place within one year of
the effective date of the Annexation. It is not anticipated that the services of this Department will
be required to a great extent within the early years of the development of this area, although
monitoring will still be conducted. Therefore, the service cost of the Department has been reduced
by two- thirds to reflect 'a more realistic actual cost to service the Annexation Area in the first five
years.

E. Environmental Services
Environmental Services provides wastewater treatment and administers the City's sanitation
service (trash pickup). These services are supported by user fees, and are paid through the Water
Works billing system. Industrial customers are not served:
Single family rate: $8.00 per month
Senior rate:
$5.50 per month.
Duplex rate:
$10.50 per month
Tri-plex:
$13.00 per month
Quad:
$15.00 per month
Recycling fee:
$1.97 per month

F. Administrative Services
The City of South Bend provides a wide range of services other than those noted above, such as
the Mayor's office, the Legal Department, and the Parks & Recreation.
These services are available upon the effective date of the Annexation. Full and dedicated
response for non - capital services will be in place within one year of the effective date of the
Annexation.
The incorporation of the Annexation Area will not effect the provision of other services currently
provided to this property on a county -wide basis. The St. Joseph County Health Department, the
St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County/South
Bend Building Department are some of the county -wide agencies and their services that will
continue to provide the same type and level of services to the Annexation Area.
County-wide services will continue to be supported by the County and Township tax rates that will
remain in effect.

SECTION IV. FISCAL IMPACT
1) Essential city services can be made available to the residents (and territory) of the Annexation
Area in a timely and comparable fashion per the requirements of State law and this fiscal plan.
2) The City is financially able to support city services to the territory sought to be annexed.
3) Required improvements made by the petitioner and/or owner of the parcels must be made in
accordance with the standards of the City of South Bend.
4) Required improvements made by the City will be completed within the time frames provide by
State law and this fiscal plan.
5) All figures are estimates. Final cost of capital expenditures, if any, will not be determined until
bids are publicly solicited, contracts are awarded and projects are closed out.
6) Property tax revenue estimates are based on 2001 payable 2002 tax rates, taxes paid in previous
years by a comparable development, estimates of units built, and no tax abatements or
adjustments. Tax rates are subject to change every year.
7) Department expenditures and revenues are derived from the City of South Bend Budget.
8) The estimated costs to provide services, noted in Section III, Municipal Services, is a City-wide
average based on a particular budget year. In the case of the proposed development in the
Annexation Area, some of these services will not be required or possibly requested for many
years. Hence, the cost of providing services over the first five years is largely reduced (by 1/3),
and the costs reflected in this fiscal impact should be evaluated with this in mind.

ANNEXATION
Dear Ms. White:
I am attaching for filling, the above- referenced resolution, which is a companion to Bill No. 38 -03. This
Bill proposes to annex contiguous territory in German Township to the City of South Bend. The resolution indicates
the approval and adoption by the Common Council of the written plan and policy attached thereto concerning the
provision of services, both capital and non - capital in nature, to the territory to be annexed.
Mahler / Stidham is a voluntary petition. It is a 18.4 acre parcel on the north and south sides of Cleveland
Road, west of the St. Joseph Valley Parkway.
I am requesting that the attached resolution be placed on the June 9, 2003 agenda of the Common Council
meeting at which the companion Bill is given Second Reading. I will be attending the meeting as the presenter.
