ORDINANCE NO. -I ~ ~ ` ~ ~ 0 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND CHANGING THE NAME OF THE STRUCTURE NOW KNOWN AS THE "MORRIS CIVIC AUDITORIUM" TO THE "MORRIS PERFORMING ARTS CENTER" AND FIXING THE TICKET SURCHARGE RATE STATEMENT OF PURPOSE AND INTENT In 1984 the South Bend Common Council enacted Ordinance 7292-84 which permitted the Morris Civic Auditorium to allocate a portion of ticket sales to a dedicated fund for the sole purpose of "acquiring, leasing, renovating, remodeling or otherwise improving facilities of the Morris Civic Auditorium." Pursuant to that grant of authority the Morris Civic Auditorium seeks to fix a per ticket surcharge of one dollar ($1.00) to be deposited into the dedicated fund created by Ordinance No. 7292-84 and to be used for the purpose specified in that Ordinance. Such surcharge shall not apply to established not-for-profit users for their specified events benef tting and educating youth (Kindergarten to Grade 12), which users are exempt from this surcharge on a limited basis. Furthermore, the South Bend Municipal Code presently denominates the building which is currently being renovated as the "Moms Civic Auditorium". This Ordinance authorizes the renaming of this building to the "Morris Performing Arts Center" in order to more specifically define the purpose for which the structure will be used. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND AS FOLLOWS: SECTION I. The "Morris Civic Auditorium" due to its renovations will now be renamed the "Morris Performing Arts Center", effective upon passage of this ordinance. SECTION II. The Morris Performing Arts Center shall be permitted to add a one dollar ($1.00) surcharge to the price of each of its tickets to be used exclusively for "acquiring, leasing, renovating, remodeling or otherwise improving [its] facilities...." This surcharge shall not apply to established not-for-profit users, inclltding South Bend Symphony Orchestra, Broadway Theater League, Southold Dance Theater and schools located within St. Joseph County Indiana, for their specified events benefitting and educating youth (Kindergarten to Grade 12), which users are exempt from this surcharge for a maximum of four youth benefit events per organization per performing year. SECTION III.
