ORDINANCE NO. -I ~ ~ ` ~ ~ 0 <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />CHANGING THE NAME OF THE STRUCTURE NOW KNOWN AS THE "MORRIS <br />CIVIC AUDITORIUM" TO THE "MORRIS PERFORMING ARTS CENTER" AND <br />FIXING THE TICKET SURCHARGE RATE <br />STATEMENT OF PURPOSE AND INTENT <br />In 1984 the South Bend Common Council enacted Ordinance 7292-84 which permitted <br />the Morris Civic Auditorium to allocate a portion of ticket sales to a dedicated fund for the sole <br />purpose of "acquiring, leasing, renovating, remodeling or otherwise improving facilities of the <br />Morris Civic Auditorium." Pursuant to that grant of authority the Morris Civic Auditorium seeks <br />to fix a per ticket surcharge of one dollar ($1.00) to be deposited into the dedicated fund created <br />by Ordinance No. 7292-84 and to be used for the purpose specified in that Ordinance. Such <br />surcharge shall not apply to established not-for-profit users for their specified events benef tting <br />and educating youth (Kindergarten to Grade 12), which users are exempt from this surcharge on <br />a limited basis. <br />Furthermore, the South Bend Municipal Code presently denominates the building which <br />is currently being renovated as the "Moms Civic Auditorium". This Ordinance authorizes the <br />renaming of this building to the "Morris Performing Arts Center" in order to more specifically <br />define the purpose for which the structure will be used. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND AS FOLLOWS: <br />SECTION I. The "Morris Civic Auditorium" due to its renovations will now be <br />renamed the "Morris Performing Arts Center", effective upon passage of this ordinance. <br />SECTION II. The Morris Performing Arts Center shall be permitted to add a one dollar <br />($1.00) surcharge to the price of each of its tickets to be used exclusively for "acquiring, leasing, <br />renovating, remodeling or otherwise improving [its] facilities...." This surcharge shall not apply <br />to established not-for-profit users, inclltding South Bend Symphony Orchestra, Broadway <br />Theater League, Southold Dance Theater and schools located within St. Joseph County Indiana, <br />for their specified events benefitting and educating youth (Kindergarten to Grade 12), which <br />users are exempt from this surcharge for a maximum of four youth benefit events per <br />organization per performing year. <br />SECTION III.
