A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXATION AREA IN GERMAN TOWNSHIP (GABY ANNEXATION AREA) WHEREAS, there has been submitted to the Common Council of the City of South Bend, Indiana, an Ordinance and a petition by the sole (100 %) property owner which proposes the annexation of real estate located in German Township, St. Joseph County, Indiana, which is described more particularly in Section I of this Resolution, and; WHEREAS, the territory proposed to be annexed encompasses approximately 0.45 acres of land containing one house, which property is at least 12.5% contiguous to the current City limits, i.e., approximately 17.75% contiguous, generally located on the north side of Brick Road, approximately 200 feet east of New Cleveland Road, German Township, Indiana. This annexation territory is intended to be incorporated into future development by the City of South Bend and will require a basic level of municipal public services of a non- capital improvement nature, including police and fire protection, street and road maintenance, street sweeping, flushing, snow removal, and sewage collection, as well as services of a capital improvement nature, including street and road construction, possible street lighting, a sanitary sewer system, awater distribution system and a stone water system; and WHEREAS, the Common Council of the City of South Bend, Indiana, now desires to establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of services of a non - capital nature, including street and road maintenance, sewage collection, street sweeping, flushing, and snow removal, police and fire protection, and other non - capital services normally provided within the corporate boundaries, and services of a capital improvement nature, including street and road construction, possible street lighting, a sanitary sewer system, a water distribution system, and a storm water system to be furnished to the territory to be annexed; (2) the method(s) of financing those services; (3) the plan for the organization and extension of those services; (4) that services of a non - capital nature will be provided to the annexed area within one (1) year after the effective date of the annexation, and that they will be provided in a manner in standard and scope to similar non - capital services provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density; (5) that the services of a capital improvement nature will be provided to the annexed area within three (3) years after the effective date of the annexation in the same manner as the services are provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws; and (6) the plan for hiring the employees of other governmental entities whose jobs will be eliminated by the proposed annexation; and WHEREAS, the Board of Public Works of the City of South Bend, and the Board of Public Safety of the City of South Bend, have each approved a written Fiscal Plan and established a policy for the provision of services to the territory proposed to be annexed, which plan and policy the Common Council finds to be appropriate and in the best interest of the City, and, which it desires to adopt. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. It is in the best interest of the City of South Bend and the area proposed to be annexed that the real property located in German Township, St. Joseph County, Indiana, described more particularly as follows, be annexed to the City of South Bend: Part of the Southwest Quarter (1/4) of the Southwest Quarter (1/4) of Section 17, Township 38 North, range 2 east described as follows: Commencing at a point 110 feet east of the Southwest corner of the Southwest Quarter (1/4) of said Section 17; thence North parallel with the west line of said Section 17, a distance of 199.93' to an iron stake; thence East 110.02' to an iron stake; thence South and parallel with the West line of said Section 17 a distance of 199.92' to the south line of said Section 17; thence West and along the South line of said Section 17, 109.98' to the place of beginning. Section H. It shall be and hereby is now declared and established that it is the policy of the City of South Bend, to furnish services to said territory of a non - capital nature, such as police and fire protection, street and road maintenance, sewage collection, street sweeping, flushing, and snow removal, within one (1) year of the effective date of the annexation, in a manner equivalent in standard and scope to the services furnished by the City to other areas of the City regardless of similar topography, patterns of land use, or population density; and to furnish to said territory services of a capital improvement nature, such as street and road construction, possible street lighting, a sanitary sewer system, a water distribution system, and a storm water system, within three (3) years of the effective date of the annexation in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws, procedures, and planning criteria. Section III. The Common Council for the City of South Bend shall and does hereby now establish and adopt The Fiscal Plan as set forth in Exhibit "A ", attached hereto and made a part hereof, for the furnishing of said services to the territory to be annexed, which Fiscal Plan provides among other things, that sanitary sewer main lines are currently in place and available to service this annexation area; that a water main line on Brick Road can service this area and is accessible through adjacent public property; that street lighting is contingent upon final development plans but any street lighting will be paid out of the Airport Economic Development Area T1F; that street improvements will be paid out of the Airport Economic Development Area TIF; and that an approved drainage plan will be required with any improvements to Cleveland Road. Section IV. This Resolution shall be in full force and effect from and of its date of adoption by the Common Council and approval by the Mayor. Gaby ANNEXATION Dear Ms. White: I am attaching for filling, the above - referenced resolution, which is a companion to Bill No. 52 -03. This Bill proposes to annex contiguous territory in German Township to the City of South Bend. The resolution indicates the approval and adoption by the Common Council of the written plan and policy attached thereto concerning the provision of services, both capital and non - capital in nature, to the territory to be annexed. The Robert E. & Carolyn L Gaby Annexation is a voluntary petition. It is a .45 acre parcel on the north side of Brick Road, east of New Cleveland Road. The petition area represents one of three homes that will be purchased over a period of several years by Redevelopment. These homes are surrounded by intense industrial uses, and are no longer viable as residences. I am requesting that the attached resolution be placed on the August 11, 2003 agenda of the Common Council meeting at which the companion Bill is given Second Reading. There are no immediate development plans, but it is anticipated that the properties will be developed as either commercial or industrial, based on the surrounding land uses. F. Zoning & Subdivisions The site is zoned "R" Residential in unincorporated St. Joseph County. It is proposed to be zoned "A" Single Family upon incorporation. G. Population There are two people currently residing in the Annexation Area. H. Tax Rate The tax rates used are those of 2001 payable in 2002. The Township Rate will decrease by $.1908 per $100.00 of assessed valuation with the deletion of the Fire Fighting Fund, the Fire debt Fund and the Cumulative Fire assessments. The tax rate for the Annexation Area will increase by $2.8726 with the addition of the City and Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate. The net increase in property taxes will be $2.6818 per $100.00 of assessed valuation. Table 1 shows representative tax rate information as published by the St. Joseph County Auditor. I. Assessments 2002 payable 2003, St. Joseph County Auditor property tax records: Land: $5,700.00 Improvements: $38,790.00 Net: $38,490.00 Estimated net assessment at build out for the proposed development: $40,000 J. Municipal Legislative District The Annexation Area will be in the 1st District. Annexation Area K Hiring Plan It is anticipated that this annexation will not result in the elimination of jobs for employees of any other governmental entities. The German Township Trustee has been notified of this annexation. SECTION III. MUNICIPAL SERVICES A. Public Works Sewer - The sanitary sewer mains are currently in place and available to service the area No additional expenditures will be needed to extend existing sewer main facilities. Water - There is currently a 12" water main on Brick Road which intersects a 10" main on New Cleveland. The main is not immediately adjacent to the site, but is accessible, through public property and is approximately 100 feet away. No additional expenditures will be needed to extend existing water main facilities. Street Lighting - Street lighting, if provided, will be paid out of the Airport Economic Development Area TIF. Once installed, the maintenance and utility bill are paid by the City at a cost of approximately $13 per light per month. No determination as been made at this time on the number of street lights that will be required. For purposes of determining an approximate cost, the installation of 1 light is assumed, but final a count is to be determined at time of Public works approval of the engineering and construction drawings. 1 x 13 = $ 13.00 per month x 12 = $156.00 per year x 5 years = $780.00 Waivers of Annexation - No waivers of the right to remonstrate against an annexation are in effect for this area. Streets - Expansion of the U.S. 31 hidustrial Park and surrounding area as well as re- development of the Gaby property and that surrounding it are expected to result in improvements to Brick Road east of the intersection with Cleveland Road. However, these improvements are not necessary to service the Gaby property as it is currently developed. Upon annexation, this portion of Brick Road will add mileage to the roadway inventory. The new mileage will increase distributions to the City's Motor Vehicle Highway Fund and Local Road and Street Account sufficient for street maintenance, sweeping, and snow removal. Drainage Plan - Any improvements to Brick Road will require an approved drainage plan. The Sewer Maintenance Bureau will maintain the storm water system with revenues from wastewater collection and treatment. Gaby Annexation Area 6 2000 Operating Budget for the Department $2,550,312 Reconstruction/Maintenance of Roads snow removal and leaf - pick -up: $993,058 Total $3,543,370 Miles of Roadway: @472 Cost per Mile: @$7,507 New Mileage (est.) .02 miles (110') Cost for Annexation Area per year: @$150 When fully developed, this annexation area is not expected to require major capital outlays for public works vehicles or equipment. Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2, I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utility. B. Police Department The noted area would be expected to be added to the already existing Beat 22. Police patrols, traffic enforcement, and emergency responses will be part of the services the City will offer to this area. At this time it is not expected that this annexation would cause calls for service to increase significantly and it is not anticipated that it will be necessary to increase police patrols beyond the already existing beat patrol at this time. The area under consideration is not expected to cause any unusual problems. Cost for servicing this area would be expected to be absorbed by the existing budget of the Police Department, as the addition of this area would not be significant to the point of having to increase any budgetary items. Police services and response time in this area can be expected to be comparable and consistent with that as in all other areas of the City. Police coverage to this area could begin immediately upon annexation and coordination of the conversion of the 911 emergency phone system for that area . It is anticipated that the services of this Department will not be required to a great extent in the early years of the development of this area, although monitoring will still be conducted. Therefore, the service cost of the Department has been reduced by two- thirds to reflect a more realistic actual cost to service the Annexation Area in the first five years. 2000 Operating Budget for the Department: $19,596,124 Number of Parcels in City (3/1/00): @47,378 Cost per Parcel: @$414 Proposed Number of Parcels in Area: 1 Cost for Annexation Area per year: @$414 / 3 = $138 C. Fire Department The Annexation Area will be serviced primarily by Station #11, located at 3505 North Bendix Drive approximately two point four (2.4) miles away. Additional Fire Department units would respond from Fire Station #7 located at 1616 Portage Avenue which is approximately four point seven (4.7) miles away. The South Bend Fire Department does not foresee any unusual fire protection problems related to this annexation. Response times will be comparable to other areas of the City. No additional Gaby Annexation Area 7 equipment will need to be purchased or personnel hired to service the Annexation Area. Adequate water supply will be necessary as development takes place. It is anticipated that the services of this Department will not be required to a great extent in the early years of the development of this area, although monitoring will still be conducted. Therefore, the service cost of the Department has been reduced by two- thirds to reflect a more realistic actual cost to service the Annexation Area in the first five years. 2000 Operating Budget for the Department: $14,033,553 Number of Parcels in City (3/1/00): @47,378 Cost per Parcel: @$296 Proposed Number of Parcels in Area: 1 Cost for Annexation Area per year: @$296 / 3 = $65 D. Code Enforcement The Annexation Area will be added to Territory 8. The Department of Code Enforcement will be able to provide services to the Annexation Area with comparable response times. The Department will respond to calls for service upon the effective date of the Annexation. Full and dedicated response will be in place within one year of the effective date of the Annexation. It is anticipated that the services of this Department will not be required to a great extent within the early years of the development of this area, although monitoring will still be conducted. Therefore, the service cost of the Department has been reduced by two- thirds to reflect a more realistic actual cost to service the Annexation Area in the first five years. 2000 Operating Budget for the Department: $1,151,497 Number of Parcels in City (3/1/00): @47,378 Cost per Parcel: @$24 Proposed Number of Parcels in Area: 1 Cost for Annexation Area per year: @$24 / 3 = $8 E. Environmental Services Environmental Services provides wastewater treatment and administers the City's sanitation service (trash pickup). These services are supported by user fees, and are paid through the Water Works billing system. Administrative Services The City of South Bend provides a wide range of services other than those noted above, such as the Mayor's office, the Legal Department, and the Parks & Recreation. These services are available upon the effective date of the Annexation. Full and dedicated response for non - capital services will be in place within one year of the effective date of the Annexation. The incorporation of the Annexation Area will not effect the provision of other services currently provided to this property on a county-wide basis. The St. Joseph County Health Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County/South Bend Building Department are some of the county -wide agencies and their services that will continue to provide the same type and level of services to the Annexation Area. County-wide services will continue to be supported by the County and Township tax rates that will remain in effect. Gaby Annexation Area 9 SECTION IV. FISCAL IMPACT 1) Essential city services can be made available to the residents (and territory) of the Annexation Area in a timely and comparable fashion per the requirements of State law and this fiscal plan. 2) The City is financially able to support city services to the territory sought to be annexed. 3) Required improvements made by the petitioner and/or owner of the parcels must be made in accordance with the standards of the City of South Bend. 4) Required improvements made by the City will be completed within the time frames provide by State law and this fiscal plan. 5) All figures are estimates. Final cost of capital expenditures, if any, will not be determined until bids are publicly solicited, contracts are awarded and projects are closed out. 6) Property tax revenue estimates are based on 2001 payable 2002 tax rates, taxes paid in previous years by a comparable development, estimates of units built, and no tax abatements or adjustments. Tax rates are subject to change every year. 7) Department expenditures and revenues are derived from the City of South Bend Budget. 8) The estimated costs to provide services, noted in Section III, Municipal Services, is a City-wide average based on a particular budget year. In the case of the proposed development in the Annexation Area, some of these services will not be required or possibly requested for many years. Hence, the cost of providing services over the first five years is largely reduced (by 1/3), and the costs reflected in this fiscal impact should be evaluated with this in mind.
