Staff Report 11/6/2014 <br />APC # 2726 -14 <br />Owner: G Family Properties <br />Location: 1430 Mishawaka Avenue <br />Jurisdiction: City of South Bend <br />Public Hearing Date: 11/18/2014 <br />Requested Action: <br />The petitioner is requesting a zone change from LB Local Business District to CB <br />Community Business District and three variances. <br />Land Uses and Zoning: <br />On site: On site is an existing commercial structure. <br />North: To the north across Mishawaka Avenue are single family homes zoned SF2 <br />Single Family & Two Family District and a gas station zoned CB <br />Community Business. <br />East: To the east is a commercial building zoned MU Mixed Use District. <br />South: To the south is a single family home zoned S172 Single Family & Two <br />Family District. <br />West: To the west across Clover Street is a commercial building zoned LB Local <br />Business District. <br />District Uses and Development Standards: <br />The CB - Community Business District is established to provide a location for high <br />volume and high intensity commercial uses. Activities in this district are often large space <br />users which may include limited amounts of outdoor sales or outdoor operations. <br />Developments within the CB District shall be coordinated to facilitate vehicular and <br />pedestrian access from nearby residential districts. <br />Site Plan Description: <br />The site is approximately a 4,000 square foot lot with an existing 1,300 square foot <br />building. The existing building has 2 service bays that front Mishawaka Avenue. The <br />remainder of the lot is paved. Due to the size of the lot and room for drive aisles, the <br />petitioner is seeking a variance from the required 7 parking spaces to 2 spaces. The <br />parking shown on the aerial photograph that extends in to the public right -of -way is not <br />permitted without special approval by the Board of Public Works. There is an existing 6' <br />privacy fence separating this property from the single family home to the south. The <br />petitioner would like to maintain this fence in place of the required Type B: Partial <br />Screening required. <br />Zoning and Land Use History And Trends: <br />Mishawaka Avenue has historically been a mix of commercial and residential uses. The <br />site was previously a gas station and has operated with auto oriented uses even after the <br />removal of the gas pumps. <br />APC # 2726 -14 Page 1 of 3 <br />
