A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY
FOR THE PROVISION OF SERVICES TO AN ANNEXATION AREA IN
CENTRE TOWNSHIP
(DUANE O. AND VIRGINIA M. ZEIGER ANNEXATION AREA)
WHEREAS, there has been submitted to the Common Council of the City of South Bend,
Indiana, an Ordinance and a petition by the sole (100 %) property owner which proposes the
annexation ofreal estate located in Centre Township, St. Joseph County, Indiana, which is described
more particularly in Section I of this Resolution, and;
WHEREAS, the territory proposed to be annexed encompasses approximately 116.2 acres
of unimproved, vacant land, which property is at least 12.5% contiguous to the current City limits,
i.e., approximately 16% contiguous, generally located on the south side of Kern Road, approximately
2,600 feet west of U.S. 31, Centre Township, Indiana. This annexation territory is intended for
development as a single family home subdivision and will require a basic level of municipal public
services, of a non - capital improvement nature, including police and fire protection, street and road
maintenance, street sweeping, flushing, snow removal, and sewage collection, as well as services
of a capital improvement nature, including street and road construction, street lighting, a sanitary
sewer system, a water distribution system and a stone water system; and
WHEREAS, the Common Council of the City of South Bend, Indiana, now desires to
establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of
services of a non - capital nature, including street and road maintenance, sewage collection, street
sweeping, flushing, and snow removal, police and fire protection, and other non - capital services
normally provided within the corporate boundaries, and services of a capital improvement nature,
including street and road construction, street lighting, a sanitary sewer extension, a water
distribution system, and a storm water system to be furnished to the territory to be annexed; (2) the
method(s) of financing those services; (3) the plan for the organization and extension of those
services; (4) that services of a non - capital nature will be provided to the annexed area within one (1)
year after the effective date of the annexation, and that they will be provided in a manner in standard
and scope to similar non - capital services provided to areas within the corporate boundaries of the
City of South Bend, regardless of similar topography, patterns of land use, or population density; (5)
that the services of a capital improvement nature will be provided to the annexed area within three
(3) years after the effective date of the annexation in the same manner as the services are provided
to areas within the corporate boundaries ofthe City of South Bend, regardless of similar topography,
patterns of land use, or population density, and in a manner consistent with federal, state and local
laws; and (6) the plan for hiring the employees of other governmental entities whose jobs will be
eliminated by the proposed annexation; and
WHEREAS, the Board of Public Works of the City of South Bend, and the Board of Public
Safety of the City of South Bend, have each approved a written fiscal plan and established a policy
for the provision of services to the territory proposed to be annexed, which plan and policy the
Common Council finds to be appropriate and in the best interest of the City, and, which it desires
to adopt.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. It is in the best interest of the City of South Bend and the area proposed to be
annexed that the real property located in Centre Township, St. Joseph County, Indiana, described
more particularly as follows, be annexed to the City of South Bend:
A part of the Northwest Quarter of Section 2, Township 36 North, Range 2 East,
Centre Township, St. Joseph County, Indiana, being more particularly described as
follows:
Commencing at the northwest corner of said Northwest Quarter, said corner lying South 00
degrees 16 minutes 41 seconds West, a distance of 3.99 feet from a railroad spike, 0.1 feet
below the surface of the pavement; thence South 89 degrees 04 minutes 47 seconds East,
along the north line of said Northwest Quarter, a distance of 1315.56 feet to the northeast
corner of the Northwest Quarter of said Northwest Quarter and the Point of Beginning;
thence North 00 degrees 10 minutes 52 seconds East, a distance of 40.00 feet to the north
right of way line of Kern Road as platted by Walnut Farms Subdivision, recorded under
instrument number 9837229 in the Office of Recorder of St. Joseph County; thence along
said north right of way line, a distance of 1054.10 feet; thence South 00 degrees 05 minutes
01 seconds West, along the west line of property described in Instrument Number 0164689
in said Office of Recorder, a distance of 1043.82 feet to the southwest corner of said
property; thence South 89 degrees 54 minutes 59 seconds East, along the south line of said
property, a distance of261.36 feet, to the east line ofsaid Northwest Quarter, said point lying
South 00 degrees 05 minutes 01 seconds West, a distance of 1000.00 from the northeast
comer of said Northwest Quarter, said comer being marked by railroad spike, 0.1 feet below
the surface of the pavement; thence South 00 degrees 05 minutes 01 seconds West, along
said east line, a distance of 1666.86 feet to the Southeast corner of said Northwest Quarter;
thence North 89 degrees 19 minutes 47 seconds West, along the south line of said Northwest
Quarter, a distance of 2640.06 feet to the southwest corner of said Northwest Quarter; thence
North 00 degrees 16 minutes 41 seconds East, along the west line of said Northwest Quarter,
a distance of 1339.13 feet to the southwest corner of the Northwest Quarter of said
Northwest Quarter; thence South 89 degrees 10 minutes 21 seconds East, along the south line
of the Northwest Quarter of said Northwest Quarter, a distance of 1317.80 feet to the
southeast corner of the Northwest Quarter of said Northwest Quarter; thence North 00
degrees 10 minutes 52 seconds East, along the east line of the Northwest Quarter of said
Northwest Quarter, a distance of 1337.03 feet to the Point of Beginning; containing 116.206
acres, more or less;
Section II. It shall be and hereby is now declared and established that it is the policy of the
City of South Bend, to furnish services to said territory of a non - capital nature, such as police and
fire protection, street and road maintenance, sewage collection, street sweeping, flushing, and snow
removal, within one (1) year of the effective date of the annexation, in a manner equivalent in
standard and scope to the services furnished by the City to other areas of the City regardless of
similar topography, patterns of land use, or population density; and to furnish to said territory
services of a capital improvement nature, such as street and road construction, street lighting, a
sanitary sewer extension, a water distribution system, and a stone water system, within three (3)
years of the effective date of the annexation in the same manner as those services are provided to
areas within the corporate boundaries of the City of South Bend regardless of similar topography,
patterns of land use, or population density, and in a manner consistent with federal, state and local
laws, procedures, and planning criteria.
Section III. The Common Council for the City of South Bend shall and does hereby now
establish and adopt The Fiscal Plan as set forth in Exhibit "A ", attached hereto and made a part
hereof, for the furnishing of said services to the territory to be annexed, which Fiscal Plan provides
among other things, that virtually all capital improvements required to service the annexation area
will be planned, provided, and paid for by the developer subject to compliance with state and local
law.
Section IV. This Resolution shall be in full force and effect from and of its date of adoption
by the Common Council and approval by the Mayor.

SECTION I. INTRODUCTION
A. General
This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the annexation
of property in Centre Township, St. Joseph County, Indiana (hereinafter, "Annexation Area "), and
was developed through the cooperative efforts of the Area Plan Commission and the following
City Departments:

South Bend Fire Department
South Bend Police Department
Department of Code Enforcement
Department of Community and Economic Development
Department of Administration and Finance
SECTION II. GENERAL DATA
A. Location
The Annexation Area is generally located on the south side of Kern. Road, approximately 2,600
west of U.S. 31. See Map 1.
B. Legal Description
The Annexation Area is part of the Northwest Quarter of Section 2, Township 36 North, Range 2
East, Centre Township, St. Joseph County, Indiana. For a complete legal description see Table 2.
C. Contiguity
The Annexation Area is at least 1/8 (12.5 1/o) contiguous to the current City limits:

D. Size of Annexation Area
The Annexation Area is approximately 116.23 acres in area.

E. Buildings and Land Use
There are no residences in the Annexation Area.
F. Zoning & Subdivisions
The site is zoned "R" Residential in unincorporated St. Joseph County. It is proposed to be zoned
"SFl" Single Family upon incorporation.
G. Population
There are no people residing in the Annexation Area.
H. Tax Rate (This Annexation is not subject to taxation)
The tax rates used are those of 2002 payable in 2003.
The Township Rate will decrease by $.0979 per $100.00 of assessed valuation with the deletion of
the Fire Fighting Fund and the Cumulative Fire assessments.
The tax rate for the Annexation Area will increase by $2.1747 with the addition of the City and
Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate.
The net increase in property taxes will be $2.0362 per $100.00 of assessed valuation. Table 1
shows representative tax rate information as published by the St. Joseph County Auditor.
I. Assessments

Improvements: $62,200.00
Net: $39,200.00
Estimated net assessment for the proposed development of 265 lots at an estimated value per lot of
$180,000: $47,700,000.00
J. Municipal Legislative District
The Annexation Area will be in the 6th District.

K. Hiring Plan
It is anticipated that this annexation will not result in the elimination of jobs for employees of any
other governmental entities. The Centre Township Trustee has been notified of this Annexation.
SECTION III. MUNICIPAL SERVICES
A. Public Works
Sewer - The sanitary sewer mains are currently available on U.S. 31 South, east of the
Annexation Area. The developer will be required to extend the necessary sewer lines to and
through the proposed subdivision. The wastewater treatment plant and the downstream collection
facilities are adequately sized to handle the additional flow
No additional public expenditures will be needed to extend existing sewer main facilities.
Water - A 12" water main is currently available on the west side of U.S. 31 South, east of the
Annexation Area. The developer will be required to extend the necessary water lines to and
through the proposed subdivision. There is sufficient capacity for the Annexation Area.
No additional public expenditures will be needed to extend existing water main facilities.
Street Lighting - Street lighting will be required on any public rights -of -way within a subdivision.
Additional revenue to the General Fund from this Annexation Area will be more than sufficient to
pay for the street light operations. Street lights will be constructed by the developer.
Waivers of Annexation - No waivers of the right to remonstrate against an annexation are in effect
for the Annexation Area.
Streets — New public streets will be constructed by the developer The new streets will add mileage
to the roadway inventory, and this new mileage will add to the state's payments to the Motor
Vehicle Highway Fund, and the Local Road and Street Fund which will be sufficient for street
maintenance, sweeping and snow removal.
Note: It is anticipated that only sweeping and snow plowing will be required over the initial five -
year period, and that repair and replacement costs will not be needed to the fullest extent. As a
result, the cost to.maintain this roadway reflects reduced cost by one - third.
Drainage Plan - None required at this time. Will be addressed through the subdivision process.

When fully developed, this annexation area is not expected to require major capital outlays for
public works vehicles or equipment.
Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2,
I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer
Utility.
B. Police Department
The noted area would be expected to be added to the already existing BEAT 15. Police patrols,
traffic enforcement, and emergency responses will be part of the services the City will offer to this
area. This proposed annexation would require officers to cover a relatively small additional area to
this beat. It is located in an area of the city that was recently annexed into the City and is expected
to Continue to crow, both in commercial development as well as residential.
At this time it is not expected that this annexation would cause calls for service to increase
significantly and it is not anticipated that it will be necessary to increase police patrols beyond the
already existing beat patrol at this time. The area under consideration is not expected to cause any
unusual problems. Cost for servicing this area would be expected to be absorbed by the existing
budget of the Police Department, as the addition of this area would not be significant to the point
of having to increase any budgetary items. Police services and response time in this area can be
expected to be comparable and consistent with that as in all other areas of the City. Police
coverage to this area could begin immediately upon annexation and coordination of the conversion
of the 911 emergency phone system for that area.
Note: It is anticipated that the services of this Department will not be required to a great extent,
although monitoring will still be conducted. Therefore, the service cost of the Department has
been reduced by two- thirds to reflect a more realistic actual cost to service the Annexation Area in
the first five years.

C. Fire Department
The Annexation Area will be serviced primarily by Station #10, located at 5303 York Road
approximately two point eight (2.8) miles away. Additional Fire Department units would respond
from Fire Station #8 located at 2402 Twyckenham Drive which is approximately four point seven
(4.7) miles away.
The South Bend Fire Department does not foresee any unusual fire protection problems related to
this annexation. Response times will be comparable to other areas of the City. No additional
equipment will need to be purchased or personnel hired to service the Annexation Area. Adequate
water supply will be necessary as development takes place.
Note: It is anticipated that the services of this Department will not be required to a great extent,
although monitoring will still be conducted. Therefore, the service cost of the Department has
been reduced by two- thirds to reflect a more realistic actual cost to service the Annexation Area in
the first five years.

D. Code Enforcement

The Annexation Area will be added to Territory 5.
The Department of Code Enforcement will be able to provide services to the Annexation Area with
comparable response times. The Department will respond to calls for service upon the effective
date of the Annexation. Fnll and dedicated response will he in Place within one year of the
effective date of the Annexation.
It is anticipated that the services of this Department will be minimally required to service the
Annexation Area in the first five years. Therefore, the service cost of the Department has been
reduced by one -third to reflect a more realistic actual cost to service the Annexation Area in the
first five years.

E. Environmental Services
Environmental Services provides wastewater treatment and administers the City's Solid Waste
service. These services are supported by user fees, and are paid through the Water Works billing
system. Industrial customers are not served:

F. Administrative Services
The City of South Bend provides a wide range of services other than those noted above, such as
the Mayor's office, the Legal Department, and the Parks & Recreation.
These services are available upon the effective date of the Annexation. Full and dedicated
response for non - capital services will be in place within one year of the effective date of the
Annexation. Cost for these services have not been calculated.
The incorporation of the Annexation Area will not effect the provision of other services currently
provided to this property on a county -wide basis. The St. Joseph County Health Department, the
St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County /South
Bend Building Department are some of the county -wide agencies and their services that will
continue to provide the same type and level of services to the Annexation Area.
County -wide services will continue to be supported by the County and Township tax rates that will
remain in effect.

SECTION IV. FISCAL IMPACT
1) Essential city services can be made available to the residents (and territory) of the Annexation
Area in a timely and comparable fashion per the requirements of State law and this fiscal plan.
2) The City is financially able to support city services to the territory sought to be annexed.
3) Required improvements made by the petitioner and/or owner of the parcels must be made in
accordance with the standards of the City of South Bend.
4) Required improvements made by the City will be completed within the time frames provide by
State law and this fiscal plan.
5) All figures are estimates. Final cost of capital expenditures, if any, will not be determined until
bids are publicly solicited, contracts are awarded and projects are closed out.
6) Property tax revenue and land assessment estimates are based on a combination of: 2002
payable 2003 tax rates, taxes paid in previous years by a comparable development, estimates of
units built, estimates of unit values and land assessments, and tax abatements or adjustments, if
any. Tax rates are subject to change every year.
7) Department expenditures and revenues are derived from the City of South Bend Budget.
8) The estimated costs to provide services, noted in Section III, Municipal Services, is a City -wide
average based on a particular budget year. In the case of the proposed development in the
Annexation Area, some of these services will not be required or possibly requested for many years.
Hence, the cost of providing services over the first five years is largely reduced, and the costs
reflected in this fiscal impact should be evaluated with this in mind.

OF SERVICES TO AN ANNEXED AREA IN CENTRE TOWNSHIP - Duane O. and Virginia M. Zeiger
ANNEXATION
Dear Ms. White:
I am attaching for filling, the above- referenced resolution, which is a companion to Bill No. 10 -04. This
Bill proposes to annex contiguous territory in Centre Township to the City of South Bend. The resolution indicates
the approval and adoption by the Common Council of the written plan and policy attached thereto concerning the
provision of services, both capital and non - capital in nature, to the territory to be annexed.
Duane O. and Virginia M. Zeiger is a voluntary petition. It is a 116.2 acre parcel on the south side of Kern
Road, west of US 31. All public improvements will be required to be done at the expense of the developer.
I am requesting that the attached resolution be placed on the April 12, 2004 agenda of the Common Council
meeting at which the companion Bill is given Second Reading. I will be attending the meeting as the presenter.
