Ordinance No. 0 33 6'( <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE, <br />ARTICLE 11, DEFINITIONS TO REVISE THE DEFINITION OF <br />ACCESSORY (STRUCTURE, BUILDING OR USE) <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council of the City of South Bend, Indiana, adopted a new zoning ordinance <br />that went into effect on May 7, 2004. The Common Council is desirous in promoting <br />educational opportunities throughout the City, and in so doing, is supportive of a citizen -led <br />"Get Booked" reading program where citizens and organizations may place "Book Huts ", <br />AKA Little Free Libraries, on both private and public property throughout the City where <br />citizens of all ages may deposit or withdraw books at no charge. Therefore, the following <br />change needs to be made to the Zoning Ordinance to exempt small accessory structures, as <br />defined, from required setbacks. <br />NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />Section I. Chapter 21, Zoning, of the South Bend Municipal Code, Article 11 Definitions, <br />Section 21 -11.02 Definitions, is hereby amended as follows: <br />Accessory (Structure, Building or Use): A subordinate structure, building or use, except for a <br />structure or buildings that is less than four (4) square feet in area and six feet W) in <br />height, that is customarily associated with, and is appropriately and clearly incidental <br />and subordinate in use, size, bulk, area and height to the primary structure, building, <br />or use, and is located on the same lot as the primary building, structure, or use. <br />Section H.
