A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY
FOR THE PROVISION OF SERVICES TO AN ANNEXATION AREA IN
GERMAN TOWNSHIP
(JIM & DONNA GREGAR/ARTHUR & NANCY BEALL ANNEXATION AREA)
WHEREAS, there has been submitted to the Common Council of the City of South Bend,
Indiana, an Ordinance and a petition by the sole (100 %) property owner which proposes the
annexation of real estate located in German Township, St. Joseph County, Indiana, which is
described more particularly in Section I of this Resolution, and;
WHEREAS, the territory proposed to be annexed encompasses approximately 1.03 acres
of land containing two single family homes, which property is at least 12.5% contiguous to the
current City limits, i.e., approximately 93% contiguous, generally located at the northeast comer of
Cleveland Road and Brick Road. It is anticipated that in the future the annexation area may be
developed for either commercial or industrial use, which will require a basic level of municipal
public services, of a non - capital improvement nature, including police and fire protection, street and
road maintenance, street sweeping, flushing, snow removal, and sewage collection, as well as
services of a capital improvement nature, including street and road construction, street lighting, a
sanitary sewer system, a water distribution system, a storm water system and drainage plan; and
WHEREAS, the Common Council of the City of South Bend, Indiana, now desires to
establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of
services of a non - capital nature, including street and road maintenance, sewage collection, street
sweeping, flushing, and snow removal, police and fire protection, and other non - capital services
normally provided within the corporate boundaries, and services of a capital improvement nature,
including street and road construction, street lighting, a sanitary sewer extension, a water
distribution system, and a storm water system to be furnished to the territory to be annexed; (2) the
method(s) of financing those services; (3) the plan for the organization and extension of those
services; (4) that services of a non - capital nature will be provided to the annexed area within one (1)
year after the effective date of the annexation, and that they will be provided in a manner in standard
and scope to similar non - capital services provided to areas within the corporate boundaries of the
City of South Bend, regardless of similar topography, patterns of land use, or population density; (5)
that the services of a capital improvement nature will be provided to the annexed area within three
(3) years after the effective date of the annexation in the same manner as the services are provided
to areas within the corporate boundaries of the City of South Bend, regardless of similar topography,
patterns of land use, or population density, and in a manner consistent with federal, state and local
laws; and (6) the plan for hiring the employees of other governmental entities whose jobs will be
eliminated by the proposed annexation; and
WHEREAS, the Board of Public Works of the City of South Bend, and the Board of Public
Safety of the City of South Bend, have each approved a written fiscal plan and established a policy
for the provision of services to the territory proposed to be annexed, which plan and policy the
Common Council finds to be appropriate and in the best interest of the City, and, which it desires
to adopt.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. It is in the best interest of the City of South Bend and the area proposed to be
annexed that the following described real property located in German Township, St. Joseph County,
Indiana, be annexed to the City of South Bend:
A part of the Southwest Quarter of the Southwest Quarter of Section 17, Township
Thirty Eight (38) North, Range Two (2) East; and the Northwest Quarter of the
Northwest Quarter of Section 20, Township Thirty Eight (38) North, Range Two (2)
East, all in German Township, St. Joseph County, Indiana, and more particularly
described as:
Beginning 220' East of the Southwest corner of the Southwest Quarter of Section 17,
Township Thirty Eight (38) North, Range Two (2) East; thence North 200'; thence
East 110'; thence South 159.89'; thence East along the north right -of -way line of
Brick Road 60.21 feet to the Southwest corner of Lot 2 of Daugherty Minor
Subdivision; thence North along the west line of said subdivision 165.62 feet to the
Northwest corner of said subdivision; thence East along the north line of said
subdivision 138.06 feet to the Northeast corner of said subdivision; thence south
along the East line of said subdivision 164.94 feet to the Southeast corner of said
subdivision; thence West along the South line of said subdivision and also being the
North right -of -way line of Brick Road 90 feet more or less to a point 80 feet north of
the Northeast corner of Lot 1 of Kiskowski 2nd Minor Subdivision; thence South 80
feet to the Northeast corner of Lot 1 of Kiskowski 2nd Minor Subdivision; thence
South along the East line of said subdivision 211.26 feet to the Southeast comer of
said subdivision and also being the North right -of -way line of Cleveland Road;
thence in a Northwesterly direction along the North right -of -way line Cleveland Road
to the Southwest corner of said subdivision; thence North along the West line of said
subdivision to the Northwest corner of said subdivision and also being the South
right -of -way line of Brick Road; thence in a Northwesterly direction 70 feet to apoint
330 feet East of the Southwest corner of the Southwest Quarter of Section 17,
Township Thirty Eight (3 8) North, Range Two (2) East, also being on the South line
of said Section; thence 110 feet West along the South line of said Section to the point
of beginning.
Section II. It shall be and hereby is now declared and established that it is the policy of the
City of South Bend, to famish services to said territory of a non - capital nature, such as police and
fire protection, street and road maintenance, sewage collection, street sweeping, flushing, and snow
removal, within one (1) year of the effective date of the annexation, in a manner equivalent in
standard and scope to the services furnished by the City to other areas of the City regardless of
similar topography, patterns of land use, or population density; and to furnish to said territory
services of a capital improvement nature, such as street and road construction, street lighting, a
sanitary sewer extension, a water distribution system, a storm water system, and drainage plan,
within three (3) years of the effective date of the annexation in the same manner as those services
are provided to areas within the corporate boundaries of the City of South Bend regardless of similar
topography, patterns of land use, or population density, and in a manner consistent with federal, state
and local laws, procedures, and planning criteria.
Section III. The Common Council for the City of South Bend shall and does hereby now
establish and adopt The Fiscal Plan as set forth in Exhibit "A ", attached hereto and made a part
hereof, for the furnishing of said services to the territory to be annexed, which Fiscal Plan provides
among other things, that existing water mainlines and sewer mainlines will be sufficient to service
this area, with sewer upgrades to be provided in the future; that no new street lighting will be needed;
that no new streets are contemplated at this time for this annexation area; and that runoff from this
property is accommodated in the roadside drainage system.
Section IV. This Resolution shall be in full force and effect from and of its date of adoption
by the Common Council and approval by the Mayor.

SECTION I. INTRODUCTION
A. General
This Fiscal Plan represents the City of South Bend's (hereinafter, "City") policy for the annexation
of property in German Township, St. Joseph County, Indiana (hereinafter, "Annexation Area "),
and was developed through the cooperative efforts of the Area Plan Commission and the following
City Departments:

Department of Administration and Finance
SECTION II. GENERAL DATA
A. Location
The Annexation Area is generally located at the northeast comer of Cleveland Road and Brick
Road. See Map 1.
B. Legal Description
The Annexation Area is part of the Southwest Quarter of the Southwest Quarter of Section 17,
Township 38 North, Range 2 East, and the Northwest Quarter of the Northwest Quarter of Section
20, Township 38 North, Range 2 East, all in German Township, St. Joseph County, Indiana. For a
complete legal description see Table 2.
C. Contiguity
The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City limits:

Non - Contiguous 100 feet 7%
Total 1,448.14 feet 100%
D. Size of Annexation Area
The Annexation Area is approximately 1.03 acres in area.

E. Buildings and Land Use
There are currently two homes in the Annexation Area. The homes will eventually be tom down.
No specific land use is being proposed at the present time, but the land will most likely be
incorporated into a commercial or industrial development in the future.
F. Zoning & Subdivisions
The site is zoned "R" Residential in unincorporated St. Joseph County. It is proposed to be zoned
"SFI" Single - family Residential upon approval of the City Council and incorporation into the City
of South Bend.
G. Population
Four people reside in the Annexation Area.
H. Tax Rate
The tax rates used are those of 2003 payable in 2004.
The Township Rate will decrease by $.1142 per $100.00 of assessed valuation with the deletion of
the Fire Fighting Fund, the Fire Equipment Debt Fund and the Cumulative Fire assessments.
The tax rate for the Annexation Area will increase by $2.2954 with the addition of the City and
Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate.
The net increase in property taxes will be 52.1812 per $100.00 of assessed valuation. Table]
shows representative tax rate information as published by the.St. Joseph County Auditor.

The Annexation Area will be in the 1st District.

K Hiring Plan
It is anticipated that this annexation will not result in the elimination of jobs for employees of any
other governmental entities. The German Township Trustee has been notified of this Annexation.
SECTION III. MUNICIPAL SERVICES
A. Public Works
Sewer - Sanitary sewer (8 ") is currently in place and available to serve the Annexation Area. The
continued development of the surrounding area for industrial uses include plans for upgrading the
sewer service.
No additional public expenditures will be needed to extend existing sewer main facilities for this
particular annexation.
Water - Water mains (12 ") are currently in place and available to serve the Annexation.
No additional public expenditures will be needed to extend existing water main facilities.
Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2,
I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer
Utility.
Street Lighting - No new street lighting will be needed.
Waivers of Annexation - Waivers of annexation are not required for the Annexation Area.
Streets — No new streets are contemplated at this time for the Annexation Area.
Drainage Plan — Runoff from this property is accommodated in the roadside drainage system.

When fully developed, this annexation area is not expected to require major capital outlays for
public works vehicles or equipment. Cost of road maintenance will be greatly reduced during the
early years of this development in anticipation that major repairs will not be needed.
B. Police Department
The noted area would be expected to be added to the already existing BEAT 22. Police patrols,
traffic enforcement, and emergency responses will be part of the services the City will offer to this
area. This proposed annexation would require officers to cover a relatively small additional area to
this beat.
At this time it is not expected that this annexation would cause calls for service to increase
significantly and it is not anticipated that it will be necessary to increase police patrols beyond the
already existing beat patrol at this time. The area under consideration is not expected to cause any
unusual problems. Cost for servicing this area would be expected to be absorbed by the existing
budget of the Police Department, as the addition of this area would not be significant to the point
of having to increase any budgetary items. Police services and response time in this area can be
expected to be comparable and consistent with that as in all other areas of the City. Police
coverage to this area could begin immediately upon annexation and coordination of the conversion
of the 911 emergency phone system for that area.
It is anticipated that the services of this Department will be minimally required to service the
Annexation Area in the first five years. Therefore, the service cost of the Department has been
reduced by one -third to reflect a more realistic actual cost to service the Annexation Area in the
first five years.
Note: The cost of service for this Annexation Area is based on the number of parcels. Household
information is provided for comparative purposes.

The Annexation Area will be serviced primarily by Station #11, located at 3505 N. Bendix Drive
approximately point two point four (2.4) miles away. Additional Fire Department units would
respond from Fire Station 47 located at 1616 Portage Avenue which is approximately four point
seven (4.7) miles away.
The South Bend Fire Department does not foresee any unusual fire protection problems related to
this annexation. Response times will be comparable to other areas of the City. No additional

equipment will need to be purchased or personnel hired to service the Annexation Area. Adequate
water supply will be necessary as development takes place.

Annexation Area in the first five years. Therefore, the service cost of the Department has been

The Department of Code Enforcement will be able to provide services to the Annexation Area with
comparable response times. The Department will respond to calls for service upon the effective
date of the Annexation. Full and dedicated response will be in place within one year of the
effective date of the Annexation.
It is anticipated that the services of this Department will be minimally required to service the
Annexation Area in the first five years. Therefore, the service cost of the Department has been
reduced by one -third to reflect a more realistic actual cost to service the Annexation Area in the

E. Environmental Services
Environmental Services provides wastewater treatment and administers the City's Solid Waste
service. These services are supported by user fees, and are paid through the Water Works billing
system. Industrial and apartment customers are not served:

F. Administrative Services
The City of South Bend provides a wide range of services other than those noted above, such as
the Mayor's office, the Legal Department, and the Parks & Recreation.
These services are available upon the effective date of the Annexation. Full and dedicated
response for non - capital services will be in place within one year of the effective date of the
Annexation. Costs for these services have not been calculated.
The incorporation of the Annexation Area will not effect the provision of other services currently
provided to this property on a county -wide basis. The St. Joseph County Health Department, the
St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County/South
Bend Building Department are some of the county -wide agencies and their services that will
continue to provide the same type and level of services to the Annexation Area.
County -wide services will continue to be supported by the County and Township tax rates that will
remain in effect.

SECTION IV. FISCAL IMPACT
1) Essential city services can be made available to the residents (and territory) of the Annexation
Area in a timely and comparable fashion per the requirements of State law and this fiscal plan.
2) The City is financially able to support city services to the territory sought to be annexed.
3) Required improvements made by the petitioner and/or owner of the parcels must be made in
accordance with the standards of the City of South Bend.
4) Required improvements made by the City will be completed within the time frames provide by
State law and this fiscal plan.
5) All figures are estimates. Final cost of capital expenditures, if any, will not be determined until
bids are publicly solicited, contracts are awarded and projects are closed out.
6) Property tax revenue and land assessment estimates are based on a combination of. 2003
payable 2004 tax rates, taxes paid in previous years by a comparable development, estimates of
units built, estimates of unit values and land assessments, and tax abatements or adjustments, if
any. Tax rates are subject to change every year.
7) Department expenditures and revenues are derived from the City of South Bend Budget.
8) The estimated costs to provide services, noted in Section III, Municipal Services, is a City-wide
average based on a particular budget year. In the case of the proposed development in the
Annexation Area, some of these services will not be required or possibly requested for many years.
Hence, the cost of providing services over the first five years is adjusted, and the costs reflected in
this fiscal impact should be evaluated with this in mind.

Dear Ms. White:
I am attaching for filling, the above - referenced resolution, which is a companion to Bill No. 89 -04. This
Bill proposes to annex contiguous territory in German Township to the City of South Bend. The resolution indicates
the approval and adoption by the Common Council of the written plan and policy attached thereto concerning the
provision of sen ices, both capital and non - capital in nature, to the territory to be annexed.
Jim & Donna Gregar / Arthur & Nancy Beall is a voluntary petition. It is a 1.03 acre parcel on the north
side of Brick Road, at its intersection with Cleveland Road. All public improvements will be required to be done at
the expense of the developer.
I am requesting that the attached resolution be placed on the January 10, 2005 agenda of the Common
Council meeting at which the companion Bill is given Second Reading. I will be attending the meeting as the
presenter.
