Jones Petrie Rafinski has submitted a proposal in <br /> the amount of$9,900 plus costs for postage and fees associated with the replatting and <br /> rezoning. Staff recommends approval of the proposal in a not to exceed amount of <br /> $10,900. <br /> 1 <br /> Ms. Greene noted that while working toward the Swing Batter Swing project, it was a real <br /> challenge to work with the various entities that owned the property needed for that project. <br /> The properties had been acquired by various government bodies over the years and were <br /> under different ownership. The plan is for the Redevelopment Commission to retain <br /> ownership of parcels that would be good for economic development, the Park Dept. would <br /> have a nice clean campus for the ballpark, and the batting cage facility would be carved out <br /> of that. Mr. Berlin is picking up the costs associated with his portion of the replat. The <br /> city won't be picking up any costs but their own. <br /> Upon a motion by Ms. Schey, seconded by Mr. Downes and unanimously carried, the <br /> Commission approved the proposal from Jones Petrie Rafinski for the scope of services <br /> proposed and a not-to-exceed amount of$10,900. <br /> D. Airport Economic Development Area <br /> (1) Environmental Indemnity Agreement funding (Studebaker Building#84, Ignition <br /> Park) <br /> Mr. Zeeb noted that on October 25, 2012 the Commission approved an Environmental <br /> Indemnity Agreement(EIA) for remediation of the Studebaker Building #84 site, the last <br /> remaining Studebaker manufacturing building. When approved, the $3.3M in funding was <br /> a best cost estimate based on known asbestos, PCB, and lead based paint contaminants. At <br /> the time, it was contemplated that soil and ground water sampling may be needed <br /> eventually. Lead based paint is currently being remediated and quotes have been received <br /> to remove waste barrels discovered in the building. Staff requests approval for an <br /> additional $475,000 to fund removal of the waste barrels, to award change orders for the <br /> lead based paint contact, to award change orders to Weaver Boos for work exceeding their <br /> original scope of services, and to remove PCB contaminated concrete located in a <br /> transformer pit in the building. <br /> Ms. Schey asked why we would use TTF funds for remediation rather than funds received <br /> from the insurance settlement agreements. Mr. Zeeb responded that the EIA always <br /> contemplated using TIF funds. There is still $6.5M in cash in Fund 227 which holds the <br /> settlement funds. Those funds are expected to be used for the Volunteer Remediation <br /> 10 <br /> 1 <br />
