RESOLUTION NO.
A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY
RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF
SOUTH BEND, INDIANA, COMMONLY KNOWN AS
501 West South Street
AS AN ECONOMIC REVITALIZATION AREA FOR
PURPOSES OF AN EIGHT (8) YEAR REAL
PROPERTY TAX ABATEMENT FOR
SWING- BATTER -SWING, LLC
WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a
Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas
for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area commonly known as 501 West
South Street, South Bend, Indiana, and which is more particularly described as follows:

& Lot 15 Blk 8 Pt Lots 31 -39 Blk 9
Lot 9 -13 Pt 14 Blk 10 Vails Sw Add

and which has Key Number 018 - 3014 - 051501 be designated as an Economic Revitalization Area;
and
WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing
before the Council has been published pursuant to Indiana Code 6- 1.1- 12.1 -2.5; and
WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrance's and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for an economic
revitalization area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana, as follows:
SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the
area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such
designation is for Real property tax abatement only and is limited to two (2) calendar years from
the date of adoption of the Declaratory Resolution by the Common Council.
SECTION II. The Common Council hereby determines that the property owner is qualified for
and is granted Real property tax deduction for up to a period of eight (8) years as shown by the
attachment pursuant to Indiana Code 6 -1.1- 12.1 -17. This resolution is adopted as an exception to
the current City Code regarding the applicable business type for the following reasons: (1) the
project places municipal vacant land on the tax rolls; (2) the project attracts potential regional
major league affiliates; and (3),the project provides additional space for youth participation at the
Four Winds Field. This further determines that the petition, the Memorandum of Agreement
between the Petitioner and the City of South Bend, and the Statement of Benefits comply with
Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6- 1.1 -12
et sea.
SECTION III. This Resolution shall be in full force and effect from and
Common Council and approved by the Mayor. 1

Swing- Batter -Swing has amended their original petition. They have changed the
estimated square footage and also their description of the new facility.
Swing- Batter -Swing is building a first class indoor hitting and training facility. The
facility will have a floor area of 17,727 gross square feet with 15,202 net square feet. The
project cost remain at $1,000,000 and Richard Hill, attorney for Swing - Batter -Swing has
confirmed the project cost will not change.
The facility will consist of six indoor tunnels and two regulation pitching mounds. In
addition to the facility being used by the Silver Hawks and visiting Midwest League
teams, the facility will be operated on an annual basis for the region. There will be the
opportunity for individual training, team training, or even the ability to bring out the
family and spend time in the batting change. The intent is to cater to both baseball and
softball. The facility would be run by a full -time, reputable baseball professional. There
will be a second level, known as the observation deck that will provide an area for
parents to watch their kids participate. It will be an exciting facility that will help attract
more people to South Bend outside of Silver Hawks baseball season. The facility will be
available for a number of game -day activities that will complement the existing family -
focused attractions at the stadium on game days and also will be available to be rented by
individuals and groups for other special events.
The project meets the qualifications for an eight -year real property tax abatement and a
representative from Swing- Batter - Swing, LLC will be available to meet with the
Committee on Monday, September 22, 2014.

Attached please find the second amended petition of Swing - Batter- Swing, LLC (the
"Petitioner "), the owner of the South Bend Silver Hawks professional baseball franchise,
seeking real property tax abatement for a proposed professional batting facility to be
constructed on property currently owned by the City of South Bend.
This amended application corrects the square footage description of the facility on the
first page of the Petition to make it consistent with the square footage referenced in the
project overview.
