REGULAR MEETING SEPTEMBER 9 2014 282 <br />OF THE CITY OF SOUTH BEND, INDIANA <br />AUTHORIZING TRANSFER OF PROPERTIES <br />TO NON-PROFIT CORPORATION <br />(520 Cushing) <br />WHEREAS, the City of South Bend, Indiana, Board of Public Works (the `Board") has <br />custody of and may maintain and dispose of all real property owned by the City of South Bend, <br />Indiana (the "City") pursuant to I.C. 36-9-6-3 and I.C. 36-1-11-1; and <br />WHEREAS, the City is the owner of the residential real property identified in Exhibit <br />"A" attached hereto (the "City Parcel"); and <br />WHEREAS, pursuant to IC 36-1-11-1 (b) (20), the City may transfer a residential <br />structure to a non-profit corporation that is organized to expand the supply or sustain the existing <br />supply of good quality, affordable housing for the residents of Indiana having low or moderate <br />incomes; and <br />WHEREAS, the South Bend Heritage Foundation, Inc., is an Indiana non-profit <br />domestic corporation ("SBHF") which is organized to expand the supply or sustain the existing <br />supply of good quality, affordable housing for the residents of Indiana having low or moderate <br />incomes; and <br />WHEREAS, SBHF has requested that the City transfer the City Parcel to SBHF in <br />furtherance of the efforts of SBHF to rehabilitate and offer the City Parcel to residents with low <br />or moderate incomes (the "Plan"); and <br />WHEREAS, the Board determines the Plan would serve the best interests and welfare of <br />the residents of the City and that the Plan would be facilitated by the transfer of the City Parcel <br />to SBHF; and <br />WHEREAS, the Board desires to transfer the City Parcel to SBHF; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: <br />1. The transfer of the City Parcel by the Board to SBHF shall be, and hereby is, <br />approved and authorized. <br />2. The Deputy Mayor and Clerk of the City are authorized to execute any <br />documents necessary to effect the intent of the Board, pursuant to the terms and conditions <br />evidenced by this Resolution. <br />This Resolution shall be in full force and effect upon its adoption by the Board. <br />ADOPTED at a meeting of the Board of Public Works of the City of South Bend, Indiana <br />held on September 9, 2014, at 1308 County -City Building, 227 West Jefferson Boulevard, South <br />Bend, Indiana 46601. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/ Gary A.
