ORDINANCE NO. 3�3 <br />AN ORDINANCE REQUIRING THE NEW YORK CENTRAL RAILROAD <br />COMPANY, THE NEW JERSEY, INDIANA AND ILLINOIS RAIL- <br />ROAD COMPANY AND THE INDIANA NORTHERN RAILROAD COM- <br />PANY TO PROVIDE AND MAINTAIN FLASH LIGHT SIGNALS AND <br />SHORT -ARM GATES AT THE GRADE CROSSING OF THE TRACKS <br />OF SAID RAILROADS WHERE THE SAME INTERSECT WITH SOUTH <br />WALNUT STREET FOR THE PROTECTION OF HUMAN LIFE, PRO- <br />VIDING FOR PENALTIES FOR THE VIOLATION THEREOF, AND <br />REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. <br />BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA: <br />SECTION 1. That it shall be the duty of The New York Central <br />Railroad Company, The New Jersey, Indiana and Illinois Railroad <br />Company and The Indiana Northern Railroad Company, to install, <br />maintain, operate and renew automatic flash light signals and short <br />arm gates at the crossing of South Walnut Street in the City of <br />South Bend, Indiana, where the same intersects the tracks of said <br />railroad companies. <br />SECTION 2. That said railroad companies coming under the pro- <br />visions of Section 1 of this ordinance are granted and given a <br />period of six (6) months from and after the passage of this <br />ordinance to comply with the terms thereof; that it shall be the <br />duties of such companies to notify the City of South Bend any time <br />within the period granted herein that they have complied with the <br />requirements as herein set forth as to such installation of gates <br />and flash light signals and, until such notification is received, <br />the said railroad companies shall maintain such protection at the <br />crossings as now exist. This period may be extended upon proper <br />showing by the Railroad Companies that difficulty is being encountered <br />obtaining the necessary materials. <br />SECTION 3. Any persons, person, firm or corporation who vio- <br />tes any of the provisions of this ordinance or any section or <br />ause thereof, or shall fail or refuse to perform any of the re- <br />irements or duties herein required of him, or it, to be performed <br />all, upon conviction, be fined in a sum not to exceed Fifty <br />
