ORDINANCE NO. 1o3 <br />AN ORDINANCE PROHIBITING THE PASSING OF MOTOR <br />VEHICLES BY TRUCKS AND TRAILERS ON PUBLIC STREETS <br />IN THE CITY OF SOUTH BEND, INDIAEA <br />BE IT ORDAINED by the Cemmon Council of the City of South Bend, <br />Indiana, that, <br />SECTION 1. It shall be unlawful for the operator, or driver of <br />any truck or trailer to pass any other moving motor vehicle travel- <br />ing in the same direction upon anv.,public street within the city <br />limits of the City of South Bend.,Indiana. <br />SECTION 2. A truck or trailer is hereby defined to be any motor <br />vehicle which has been licensed as a truck or trailer by any state, <br />territory or country and which shall be of a manufacturer's rated <br />capacity of five (5) tons or more; and the attachment to any such <br />motor vehicle of any such license plate, or tag shall be prima facie <br />evidence of the designation of such vehicle as a truck or trailer. <br />SECTION 3. Any person violating this Ordinance shall, upon con - <br />itiction, be fined in any amount not to exceed $300. <br />SECTION 4.
