REGULAR MEETING AUGUST 12, 2014 260 <br />APPROVAL OF REVOCABLE PERMIT FOR ENCROACHMENT — MICHIANA <br />BREWER'S SUPPLY, LLC <br />Mr. Gilot stated an application for a Revocable Permit has been received for the purpose of <br />allowing a two (2) sided chalkboard sandwich sign to remain in the right -of -way at Michiana <br />Brewer's Supply, LLC., 117 S. Michigan St. The encroachment shall remain in the right of way <br />until the time as the Board of Public Works of the City of South Bend shall determine that such <br />encroachment is in any way impairing or interfering with the highway or with the free and same <br />flow of traffic. Mr. Gilot noted the applicant must maintain a five (5) foot clear pedestrian <br />walkway at all times. Upon a motion made by Ms. Roos, seconded by Mr. Henthorn and carried, <br />the Revocable Permit was approved. <br />APPROVAL OF REVOCABLE PERMIT FOR ENCROACHMENT — 521 JEFFERSON LLC <br />Mr. Gilot stated an application for a Revocable Permit has been received for the purpose of <br />allowing a New Orleans style canopy /deck to be constructed in the right -of -way at 521 E <br />Jefferson Blvd. The encroachment shall remain in the right of way until the time as the Board of <br />Public Works of the City of South Bend shall determine that such encroachment is in any way <br />impairing or interfering with the highway or with the free and same flow of traffic. Mr. Gilot <br />informed Mr. Dave Matthews that the permit is a revocable permit, and although he doesn't <br />anticipated any future problems, the City retains the right to have the encroachment removed in <br />the future if necessary. Mr. Matthews stated he understood. He explained it was determined that <br />while Jefferson Boulevard is torn up for re- construction, it would be the best time to install this <br />canopy.
