I <br />ORDINANCE NO. 4058 <br />AMENDMENT OF ZONING ORDINANCE <br />(An Ordinance amending Ordinance No. 3702, adopted June 13, 1949, and <br />commonly known as the Zoning Ordinance of the City of South Bend. <br />WHEREAS, Colpaert Realty Corporation contemplates the development of <br />Belleville Shopping Center, which is bounded on the North by Western Avenue, on <br />the East by Lombardy Drive and on the South by a line parallel to and approximately <br />679 feet South of the South line of Western Avenue; and <br />WHEREAS, Colpaert Realty Corporation has petitioned for changes of zoning <br />of three tracts in or adjacent to said proposed shopping area; and <br />WHEREAS, the City Plan Commission has recommended that the zoning of said <br />three tracts be changed as herein provided. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of <br />South Bend that Ordinance No. 3702, which Ordinance is commonly known as the <br />Zoning Ordinance of the City of South Bend, be amended to read as follows: <br />Section 1 <br />The following described real estate situated in the City of South Bend <br />be and the same is hereby rezoned as "C" Commercial Use District and "E° <br />Height and Area District: <br />Beginning at a point in the West line of Lombardy Drive 504 feet <br />South of the Northwest corner of the Southwest Quarter of Section <br />9, Township 37 North, Range 2 East; thence West 200 feet; thence <br />in a Southwesterly direction 267 feet; thence East 264 feet to the <br />West line of Lombardy Drive; thence North along the West line of Lom- <br />bardy Drive 205 feet to the place of beginning. <br />Section 2 <br />The following described real estate situated in the City of South Bend <br />be and the same is hereby rezoned as "Ctt Commercial Use District and ttE't <br />Height and Area District: <br />Beginning at a point 655 feet West and 391 feet South of the Northeast <br />corner of Section 8, Township 37 North, Range 2 Bast; thence East 110 <br />feet; thence South 104 feet; thence East 200 feet; thence in a South- <br />easterly direction 267 feet; thence West 342 feet; thence in a North- <br />westerly and Northerly direction 367 feet to the place of beginning. <br />
