PETITION TO RE -ZONE LAND <br />TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA <br />The Petitioner, National Milk Company, Inc., an Indiana <br />corporation, would represent and show to the Honorable Common <br />Council of the City of South Bend, Indiana, that said corpora- <br />tion is the legal owner of the following described real estate <br />situate in the City of South Bend, County of St. Joseph, State <br />of Indiana, to -witt <br />Lots Numbered Twenty (2O) and Twenty -one <br />(21) as shown on the recorded Plat of <br />Beyer *s Second Addition to the City of <br />South Bend, Indiana. <br />That all of said real estate is situate on the south side <br />of Mishawaka Avenue and immediately adjacent to and on the east <br />side of the Grants Trunk Railway right of way. Your petitioner <br />would further represent and show to this Honorable Body that at <br />the time of the recording of the plat containing said lots there <br />was an alley provided on the south rear of said lots extending <br />in a general easterly and westerly direction, said alley being <br />south of and parallel to said Mishawaka Avenue. That said alley <br />has heretofore been vacated by legal process and operation of <br />law and the fee simple title thereto has by operation of law <br />reverted to the petitioner. <br />Your petitioner would further represent and show that <br />Lots Numbered Twenty (2O) and Twenty -one (21) as shown on the <br />recorded Plat of Beyer's Second ,addition to the City of South <br />Bend, heretofore described in this petition, are now zoned "C" <br />Commercial Use District and "E" Height and Area District. <br />Your petitioner further represents that all of the land <br />west of Louise Street and south of the aforesaid vacated alley <br />to the St. Joseph River and east of the Grand Trunk Railroad <br />
