'�44�3 <br />AN ORDINANCE AUTHORIZING THE SALE OF VACANT <br />PROPERTY ON LINCOLN WAY EAST BELONGING TO <br />THE WATER WORKS DEPARTMENT OF THE CIVIL CITY <br />OF SOUTH BEND$ INDIANA <br />BE IT ORDAINED by the Common Council of the Civil City of South Bend, <br />Indiana: <br />SECTION I: The vacant property on Lincolnway East in the City of <br />South Bend belonging to the Water Works Department of the Civil City <br />of South Bend, Indiana, and more particularly described as follows: <br />Beginning on the North line of Lincoln Way East <br />at a point where the West line of Lot 26 South <br />Bend Mfg. Cots Addition produced southerly inter- <br />sects the Northerly line of said Lincoln Way East, <br />as now located, which point is 13.05 ft, from the <br />original South West corner of said Lot 26; thence <br />North 60 degrees West along the present northerly <br />line of said Lincoln Way East a distance of 64.86 <br />ft.; thence North 30 degrees East, at right angles <br />to the northerly line of said Lincoln Way East a <br />distance of 95.37 ft. to the intersection of the <br />westerly line of Lot 26 said South Bend Mfg. Cots <br />Addition; thence South 18 degrees West along the <br />Westerly line of said Lot 26 a distance of 34.54 <br />ft. to angle in said lot line; thence South 30 de- <br />grees West along the westerly line of said lot 26 <br />a distance of 81.87 ft. to the place of beginning, <br />all in the City of South Bend, St. Joseph County <br />Indiana, subject to an existing lease and subject <br />al o t a er etua easement for public utilities <br />b low he ura a hereof' <br />is hereby oere� sold in accordance with the provisions of this ordinance. <br />SECTION II: The Judge of the Circuit Court of St. Joseph County, Indiana <br />is requested to appoint three disinterested freeholders of the City of <br />South Bend, Indiana to appraise said property at its fair cash market value. <br />SECTION III: After such appraisal the proper legal officers of said city <br />are authorized to sell, assign, transfer, convey and set over by proper <br />legal instrument to any purchaser thereof the real estate herein above <br />described for not less than the full appraised value thereof, as reported <br />by the appraisers appointed by the Judge of the St. Joseph Circuit Court <br />and the Mayor is hereby authorized to execute and deliver to any purchaser <br />or purchasers thereof, upon the payment of the appraised value thereof, a <br />good and sufficient deed of conveyance, and this shall be sufficient authority <br />to him in said premises. <br />SECTION IV: This ordinance shall be in full force and effect from and <br />after its adoption by the Common Council and approval by the Mayor. <br />Id6.2ad REACi'IG 9-/ <br />—,¢�- <br />C'a"+'ic7TEE OF THE W40LF <br />F 'v+ -I- HEARRdG Member of the Common Council <br />3rd (irld n <br />I t.JE A::'�IED <br />s <br />
