<br />Upon a motion made by Mr. Relos, seconded by Mr. Pawlowski and carried, the above Quotations
<br />were referred to Community Investment and Engineering for review and recommendation.
<br />RECONSIDER AND AMEND BOARD'S ACTION — REINSTATE AWARD OF PART A
<br />ASPHALT MATERIALS MINUS DUST CONTROL AGENT FOR 2014 STREET AND
<br />SEWER MATERIALS — PROJECT NO. 114-004 MVH
<br />In a Memo to the Board, Attorney Cheryl Greene advised that on July 8, 2014, the award to Bit Mat
<br />Products of Indiana, Inc., for Part A Asphalt Materials, Liquids and Emulsions was rescinded for
<br />the above referenced materials due to Bit-Mat's failure to comply with the bid specifications for the
<br />Dust Control Agent, causing their bid to be deemed non -responsive to that item. It has since been
<br />determined the other asphalt products are not available locally and the City's paving program may
<br />be significantly delayed. Therefore, in order to not impair the functioning of the Street Department,
<br />the Board may wish to reinstate that portion of Part A of the bid award to Bit Mat with the
<br />exception of the Dust Control Agent. Therefore, Mr. Gilot made a motion that the recommendation
<br />be accepted and the prior action of the Board to rescind the bid award be reconsidered and amended
<br />to approval of the award to Bit Mat Products for Part A Asphalt Materials, excluding the Dust
<br />Control Agent. Ms. Roos seconded the motion, which carried.
<br />APPROVE PROJECT COMPLETION AFFIDAVIT — REMOVAL AND DISPOSAL OF PCB
<br />TRANSFORMERS AT IVY TOWER — PROJECT NO, 113-026 fAEDA TIF
<br />Mr. Gilot advised that Ms. Thia Vawter, Engineering, has submitted the Project Completion
<br />Affidavit on behalf of Clean Harbors Environmental Services, Inc., 1672 East Highland Road,
<br />Twinsburg, Ohio 44087, for the above referenced project, indicating a final cost of $106,585,00.
<br />Upon a motion made by Mr. Relos, seconded by Ms. Roos and carried, the Project Completion
<br />Affidavit was approved.
<br />ADOPT RESOLUTION NO. 25-2014 — A RESOLUTION OF THE BOARD OF PUBLIC
<br />WORKS OF THE CITY OF SOUTH BEND INDIANA ADOPTING A WRITTEN FISCAL
<br />PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN
<br />ANNEXATION AREA IN PENN TOWNSHIP DELDORA ANNEXATION AREA
<br />Upon a motion made by Ms. Roos, seconded by Mr. Relos and carried, the following Resolution
<br />was adopted by the Board of Public Works:
<br />RESOLUTION NO.25-2014
<br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF
<br />SOUTH BEND, INDIANA ADOPTING A WRITTEN FISCAL PLAN AND
<br />ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN
<br />ANNEXATION AREA IN PENN TOWNSHIP
<br />(DELDORA ANNEXATION AREA)
<br />WHEREAS, there has been submitted to the Common Council of the City of South Bend,
<br />Indiana, an Ordinance and a petition by all (100%) property owners which proposes the annexation
<br />of real estate located in Penn Township, St. Joseph County, Indiana, which is more particularly
<br />described at Page 14 of Exhibit "A" attached hereto; and
<br />WHEREAS, the territory proposed to be annexed encompasses approximately 20.0 acres of
<br />land containing vacant land, which property is at least 12.5% contiguous to the current City limits,
<br />i.e., approximately 21.0% contiguous, generally located on the south side of Ireland Road east of
<br />Ironwood Drive (17716, 17802, and 17830 Ireland Road). It is anticipated that the annexation area
<br />will be used for commercial, office, and/or high -density residential development.
<br />The development will require a basic level of municipal public services of a non -capital
<br />improvement nature, including street and road maintenance, street sweeping, flushing, snow
