ORDINANCE N0. D 6 <br />AN OPDINANCE AUTHORIZING THE SALE OF VACANT <br />PROPERTY ON LINCOLN WAY EAST BELONGING TO THE <br />WATER WORKS DEPARTMENT OF TAE CIVIL CITY (F <br />SOUTH BEND, IMIANA <br />SECTION I: The vacant property on Lincoln Way East in the City of South Berl <br />belonging to the Water Works Department of the Civil City of South Bend, Indiana <br />and more particularly described as follows <br />Beginning at a point which is 64.86 feet' North, 60 degrees West, and <br />13,05 feet South of the original Southwest corner of Lot Numbered 26, <br />South Bend Manufacturing Company's Addition; thence North 30 degrees <br />Gast, at right angles to the northerly line of Lincoln Way East ,a <br />distance of 95.37 feet to the intersection of the westerly line of Let <br />Numbered 26 in said South Bend Manufacturing Compauyts Addition; <br />thence northwesterly along the existing concrete retaining wall a <br />distance of 36.25 feet; thence southwesterly along the existing concrete <br />retaining wall 81ek feet to the present North line of Lincoln Way East; <br />thence southeasterly along the present North line of Lincoln Way East <br />30.31+ feet to the place of beginning, <br />Subject to a perpetual easement for public utilities below the surface <br />thereof and subject also to a perpetual easement for vehicular travel <br />across the Northwest 20 feet thereof and for construction of a ramp or <br />bridge at or on the northeasterly portion of said 20 feet to provide <br />vehicular access to grantor's building located on the northeasterly <br />portion of said Lot Numbered 25. <br />is hereby ordered sold in accordance with the provisions of this ordinance. <br />SECTION II: The Judge of the Circuit Court of St. Joseph County, Indiana is <br />requested to appoint three disinterested freeholders of the City of South Bend, <br />Indiana to appraise said property at its fair cash market value. <br />SECTION III: After such appraisal the proper legal officers of said city are <br />authorized.to sell, assign, transfer, convey and set over by proper legal <br />instrument to any purchaser thereof the real estate herein above described for <br />not less than the full appraised value thereof, as reported by the appraisers <br />appointed by the Judge of the St. Joseph Circuit Court and the Mayor is hereby <br />authorized to execute and deliver to any purchaser or purchasers thereof, upon <br />the payment of the appraised value thereof, a good and sufficient deed conveyance, <br />and this shall be sufficient authority to him in said premises. <br />SECTION IV: This ordinance shall be in full force and effect from and after its <br />adoption.by the common council and approval by the Mayor. <br />Isi & 2nd REAOIPJS <br />COWARME OF THE YMOLE <br />Ps.
