P E T I T 10 N <br />June 22, 1954 <br />To the Members of the Common Council <br />South Bend, Indiana <br />Gentlemen: <br />I, Ruth M. Welsheimer, the widow and surviving joint tenant of Arthur C. <br />Welsheimer, deceased, the owner of the fee simple title to the following <br />described real estate, respectfully petition the Common Council to rezone <br />the same from "B" use district and "B" height and area district to "C" use <br />district and "F" height and area district: <br />Lot Numbered Three (3) as shown on the recorded <br />plat of Burroughs Sub - division of bank out lot of No. <br />115 of the third plat of out lots to the town, now the <br />City of South Bend platted by the State Bank of Indiana, <br />excepting therefrom a lot or parcel of land 176.4 feet <br />north and south off of the entire width of the north end <br />thereof. <br />For your information and guidance, the above described real estate is taken <br />off of the south portion of lot numbered three (3) as shown on the recorded <br />plat of Burroughs sub - division of bank out lot numbered 115 of the third plat <br />of out lots to the City of South Bend. The parcel is 66 feet on the north side <br />and 66.23 feet on the south side. The eastern boundary line of said parcel <br />borders upon an alley running north and south between Navarre Street and <br />Marion Street. The west side of the lot is 56.7 feet in length. <br />a Lot numbered three (3) as aforesaid faces on Navarre Street on the north <br />and the alley aforesaid on the east. The southern boundary line of the real <br />estate herein proposed to be rezoned forms a northern boundary line of lot <br />numbered 53 of the same sub- division. Lots numbered 53 and 54 facing on <br />Marion Street with the alley aforesaid forming its eastern boundary is zoned <br />"C" use district and "F" height and area district. A Tavern and Tool and Die <br />Salesroom occupy the said lot and faces on Marion Street. The western boundary <br />line of said lot 53. is the eastern boundary line of lot numbered 54 of the same sub- <br />division, the southern boundary line of lot 54 being the north and eastern boundary <br />line of Williams Street. Lot numbered 54 has a filling station constructed upon it <br />which is now in use. <br />The petitioner operates the Welsheimer Funeral Home which is across Williams <br />Street from the real estate hereinabove described. That side of the street is also <br />zoned "C" use district and "F" height and area district. <br />The undersigned proposes to have constructed upon the above described parcel <br />of real estate a fire proof garage consisting of four stalls and a room to store <br />new caskets. You gentlemen will recall that the petitioner proposes to' construct <br />a chapel on the land west of Williams Street and there is no room on that particular <br />
