Amended Ordinance No. 0 0 <br />AN AMENDED ORDINANCE AMENDING <br />ORDINANCE NO. 3702 COi'�CIONLY KNOWN <br />AS "THE ZONING ORDINANCE OF THE <br />CITY OF SOUTH BEND, INDIANA." <br />BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: <br />SECTION I. That that part of Ordinance No. 3702, Section 17, to wit: IlSide Yards" <br />be amended so that the same shall hereafter be and read as follows: <br />Side Yard: Each lot shall have two side yards. <br />LOTS OF RECORD WHEN ORDINANCE ADOPTED. On a lot of record at the date of the <br />adoption of this Ordinance, there shall be a side yard on each side of a <br />principal building of not less than 5 feet in width. (See Section 10, (h). <br />However, on a lot of less than 40 feet in width and of record at the date of <br />the adoption of this Ordinance, each side yard may be reduced to not less <br />than 12 per cent of the width of the lot at the building line. <br />LOTS RECORDED AFTER ORDINANCE ADOPTED. On any lot 50 feet or more in width at <br />the building line and recorded after the adoption of this Ordinance, there shall <br />be two side yards which shall have a minimum combined width of 30 per cent of the <br />lot width at the building line or 18 feet, whichever is the greater; the smaller <br />of the two side yards shall be not less than 10 per cent of the total lot width <br />or 6 feet, whichever is the greater. <br />LOTS UNDER 50 FEET IN UIDTH RECORDED AFTER ORDINANCE ADOPTED. On any lot less <br />than 50 feet in width at the building line and recorded after the adoption of <br />-M this Ordinance, there shall be two side yards which have a minimum combined <br />width of 35 per cent of the lot width; the smaller of the two side yards shall <br />be not less than 7 feet. <br />ATTACHED GARAGES AND CARPORTS. A garage or carport may be erected in a side <br />yard except the side yard along the side street lot line of a corner lot provided <br />that it is attached to the principal building, fronts on the same street as the <br />principal building, and is built no closer from a side lot line than 10 per cent <br />of the lot width or 6 feet, whichever is the greater, provided, however, that <br />this requirement need not be greater than 12 feet. This provision shall apply to <br />garages and carports and to no other structure, addition, or projection. <br />CORNER LOTS. On a corner lot the least width of any side yard along the side <br />street lot line shall be 25 per cent of the width of the lot at the building line, <br />but in no case shall this requirement reduce the least width to less than 10 feet <br />nor require more than 25 feet setback, provided that on a corner lot less than <br />40 feet in width and of record at the time of the adoption of this Ordinance, <br />the buildable width need not be reduced to less than 70 per cent of the width of <br />the lot at the building line. <br />Where the rear lot line of a corner lot adjoins a side lot line of a lot in a <br />Residential District, no part of any accessory building within 25 feet of the <br />common lot line shall be nearer a side street lot line than the least depth of <br />any front yard requirement on such adjoining lot. <br />
