PETITION TO RE -ZONE LAND TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: The undersigned petitioner would represent and show to the Honorable Common Council of the City of South Bend, Indiana, that said corporation is the legal owner of the following described real estate situate in the City of South Bend, St. Joseph County, State of Indiana, to -wit: Beginning at the Northeast corner of the South one -half (g) of the Southwest quarter (j) of Section Thirty -five (35), Township Thirty -eight (38) North, Range 2 East in St. Joseph County, Indiana; thence South four hundred ninety -two (492) feet; thence West one hundred seventy -six (176) feet; thence south eight hundred thirty (830) feet to the south line of said section; thence east to the St. Joseph River; thence down stream along the edge of the river to a point due east of the point of beginning; thence west to the place of beginning. That all of said real estate prior to its purchase by thepetitioner was used and occupied by a brick manufacturing company long abandoned and was of industrial use. That your petitioner owned and had title to said real estate, consisting of approximately nineteen (19) acres, prior to the enactment and passage of the original Zoning Ordinance of the City of South Bend, Indiana, Ordinance Number 2331, adopted June 25, 1923. That pursuant to said ordinance all of said real estate was zoned "Q" Residential as to usage and "g" Height and Area as to Height and Area District, excepting that the south Three Hun- dred Twenty -two (322) feet of said real estate was zoned "D" Light Industrial District under said Zoning Ordinance. That it is necessary and expedient that petitioner ex- pand its present operations and extend its buildings now located on that parcel of land zoned "D" Light Industrial :District to keep apace with its competition and more particularly to install sliting machines in preparing its steel tubing for manufacture.
