A Variance from the requirement of providing a minimum of a 6 ft. <br />wide landscape planting area along the Blaine Avenue and Lincolnway West <br />fagades of the proposed building to no landscaping as shown. <br />5). A Variance from the requirement of providing Type "B" Residential <br />Bufferyard screening along the North (Lindsey Street), West (Blaine <br />Avenue) and South (Lincolnway West) property lines to providing <br />landscape screening consisting of small shrubs adjacent to paved areas <br />and evergreen screening along the North fagade of the proposed building <br />as shown. <br />SPECIAL EXCEPTION REQUEST: <br />1) . Approval of a Special Exception Use as allowed under Section 21- <br />03.04 (a)(2)(A) Automotive Uses, of the City of South Bend Zoning <br />Ordinance to allow for a Gasoline Service Station facility (without <br />repairs) on property zoned LB Local Business District. <br />The Petitioners are the owners of the real estate parcel shown on <br />the attached site plan and as shown in the records of the St. Joseph <br />County, Indiana Auditor's office. The Petition property presently has a <br />Zoning classification of "LB" Local Business District. <br />The property was previously used as a gasoline service station and <br />most recently for automotive service facility. The Petitioners desire to <br />raise the existing building and replace it with a Convenience/ Grocery <br />store with gasoline pumps. This property is located along Lincolnway <br />West adjacent to an existing commercial restaurant. This portion of <br />Lincolnway West carries over 19,000 vehicles per day. <br />Through discussions with the Building Department and Area Plan <br />Commission staffs, it was determined that in order to build the new <br />Convenience /Grocery store and install the gas pumps with a Canopy, <br />approval of a Special exception and a few Variances would be required <br />due to the fact the City Ordinances have changed. <br />More specifically, the following Variances and Special Exception are <br />being requested to be approved. <br />With regards to the required Variances, the first request is to be <br />allowed to encroach into the 30 ft. Front Residential Bufferyard area <br />along Lindsey Street (North property line), Blaine Avenue (West property <br />line) and Lincolnway West (South property line) to a minimum of 5 ft. <br />for parking spaces, proposed building, sidewalk and a Canopy facility <br />with pumps as shown. The existing site presently has pavement to the <br />North, West and South property lines with an old building located at the <br />Northeast corner of the property. The Petitioners would replace the <br />existing pavement and building with a new building as shown and a <br />parking area located to the West of the new building. Along Lincolnway <br />
