ORDINANCE NO. <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE AND REQUESTING A <br />SPECIAL EXCEPTION FOR PROPERTY LOCATED AT 605 NORTH HICKORY <br />ROAD, SOUTH BEND, INDIANA, COUNCILMANIC DISTRICT NO.4 IN THE <br />CITY OF SOUTH BEND, INDIANA <br />STATEMENT OF PURPOSE AND INTENT <br />PETITIONERS DESIRE TO REZONE THE PROPERTY FROM CB COMMUNITY <br />BUSINESS DISTRICT TO GB GENERAL BUSINESS DISTRICT AND ALSO REQUEST <br />APPROVAL OF A SPECIAL EXCEPTION TO OPERATE A MINI - WAREHOUSING <br />FACILITYLITY WITH OUTSIDE STORAGE WITHIN THE GB GENERAL BUSINESS <br />DISTRICT CLASSIFICATION. <br />NOW THEREFORE BE IT ORDAINED by the Common Council of the City of <br />South Bend, Indiana as follows: <br />SECTION 1. Ordinance No. 9495 -04, as amended, which ordinance is commonly <br />known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same <br />hereby is amended in order that the zoning classification of the following described real <br />estate in the City of South Bend, St. Joseph County, State of Indiana: <br />THAT PART OF THE SOUTHEAST QUARTER OF SECTION 5, TOWNSHIP 37 <br />NORTH, RANGE 3 EAST, PORTAGE TOWNSHIP, CITY OF SOUTH BEND, ST. <br />JOSEPH COUNTY, INDIANA WHICH IS DESCRIBED AS: LOT # 4 OF THE PLAT OF <br />"MC KINLEY- HICKORY MINOR SUBDIVISION" AS RECORDED BY DOCUMENT <br />NO. 0734550 IN THE RECORDS OF THE ST. JOSEPH COUNTY, INDIANA <br />RECORDER'S OFFICE, EXCEPTING THEREFROM THE FOLLOWING DESCRIBED <br />PORTION OF SAID LOT # 4; BEGINNING AT THE SOUTHEAST CORNER OF SAID <br />LOT # 4; THENCE N. 89 °28'22" W. ALONG THE SOUTH LINE OF SAID LOT A <br />DISTANCE OF 155.61 FEET-THENCE N. 00002'06"E. A DISTANCE OF 130.00 FEET- <br />THENCE S.89 °2822" E. A DISTANCE OF 145.61 FEET TO THE WEST LINE OF <br />HICKORY ROAD; THENCE ALONG SAID WEST LINE FOR THE NEXT THREE (3) <br />COURSES, S. 00 °02'06" W. A DISTANCE OF 1651 FEET AND S. 89 °5754 "E.
