7'57 PM PILED CITY OF SOUTH BEND FREOR C, N09LE, CLERK 0 PETITION FOR REZONING To the Honorable Common Council of the City of South Bend, Indiana: Gentlemen: South Bend, Indiana June 17, 1957 Belleville Investment Company, Inc. respectfully represents and alleges: 1. It is the owner in fee simple of an undivided parcel of real estate located in the City of South Bend, Indiana, at the northeast corner of the intersection of Mayflower Road and Sample Street, which parcel is a part of Area 1 as shown on the recorded replat of Belleville Unit D Addition to the City of South Bend, and which is more particularly described as follows: Beginning at a point on the East line of Mayflower Road, 38.48 feet North of Southwest corner of said Area 1; thence North along the East line of Mayflower Road; 125 feet; thence East along a line parallel to the North line of Sample Street, 125 feet; thence South along a line parallel to the East line of Mayflower Road, 163.48 feet to the North line of Sample Street; thence West along the North line of Sample Street, 88.86 feet; thence in a Northwesterly direction, 52.86 feet to the place of beginning. 2. Said parcel of real estate is presently zoned "C" 1 Limited Commercial District in keeping with the.use that petitioner had originally thought appropriate for such land at the time of the addition of such area to the City of South Bend. 3. Said real estate is vacant and it is now apparent that it can be put to its most advantageous use under the "C" General Commercial zoning classification. 4. That said property could become more productive to petitioner and to the general public of this City if the zoning thereof was so changed from "C" 1 Commercial to "C" General Commercial Use District, and such change would not be injurious to anyone. 5. That for the foregoing reasons petitioner requests the rezoning of said property as "C" Use District and "DO Height and Area District. 6. Petitioner submits herewith a drawing showing the location of the above described property, together with a proposed form of ordinance for the accomplish- ment of such rezoning. WIEREFORE, petitioner respectfully prays and requests: 1. That this Common Council refer this petition to the City Plan Commission
