7'57 PM <br />PILED <br />CITY OF SOUTH BEND <br />FREOR C, N09LE, CLERK <br />0 <br />PETITION FOR REZONING <br />To the Honorable Common Council <br />of the City of South Bend, Indiana: <br />Gentlemen: <br />South Bend, Indiana <br />June 17, 1957 <br />Belleville Investment Company, Inc. respectfully represents and alleges: <br />1. It is the owner in fee simple of an undivided parcel of real estate <br />located in the City of South Bend, Indiana, at the northeast corner of the intersection <br />of Mayflower Road and Sample Street, which parcel is a part of Area 1 as shown on the <br />recorded replat of Belleville Unit D Addition to the City of South Bend, and which is <br />more particularly described as follows: <br />Beginning at a point on the East line of Mayflower Road, 38.48 <br />feet North of Southwest corner of said Area 1; thence North along <br />the East line of Mayflower Road; 125 feet; thence East along a <br />line parallel to the North line of Sample Street, 125 feet; <br />thence South along a line parallel to the East line of Mayflower <br />Road, 163.48 feet to the North line of Sample Street; thence <br />West along the North line of Sample Street, 88.86 feet; thence <br />in a Northwesterly direction, 52.86 feet to the place of <br />beginning. <br />2. Said parcel of real estate is presently zoned "C" 1 Limited Commercial <br />District in keeping with the.use that petitioner had originally thought appropriate <br />for such land at the time of the addition of such area to the City of South Bend. <br />3. Said real estate is vacant and it is now apparent that it can be put to <br />its most advantageous use under the "C" General Commercial zoning classification. <br />4. That said property could become more productive to petitioner and to <br />the general public of this City if the zoning thereof was so changed from "C" 1 <br />Commercial to "C" General Commercial Use District, and such change would not be <br />injurious to anyone. <br />5. That for the foregoing reasons petitioner requests the rezoning of said <br />property as "C" Use District and "DO Height and Area District. <br />6. Petitioner submits herewith a drawing showing the location of the <br />above described property, together with a proposed form of ordinance for the accomplish- <br />ment of such rezoning. <br />WIEREFORE, petitioner respectfully prays and requests: <br />1. That this Common Council refer this petition to the City Plan Commission <br />
