Qj L 6 ?, <br />AN ORDINANCE AMENDING CHAPTER 29 OF <br />GENERAL ORDINANCE NO. 3709 KNOWN AS <br />THE 1949 MUNICIPAL CODE OF THE CITY <br />OF SOUTH BEND2 INDIANA BY ADDING <br />THERETO SECTION 38A ENTITLED "YIELDING <br />RIGHT OF WAY." <br />BE IT ORDAINED by the Common Council of the Civil City of South Bend, Indiana: <br />ECTION I: That Chapter 29 of General Ordinance No. 3709 known as The 1949 <br />Municipal Code of the City of South Bend, Indiana be, and the same is, hereby <br />amended by the addition of the following paragraph: <br />38A. YIELDING RIGHT OF WAY. When "Yield <br />Right of Way" signs are erected by authority <br />of the Board of Public Works and Safety <br />upon streets and highways in the City of <br />South Bend, Indiana the driver of a vehicle <br />approaching a "YIELD RIGHT OF WAY" sign <br />shall slow to a reasonable speed for existing <br />conditions of traffic and visibility, yield- <br />ing the right of way to all traffic on the <br />intersecting street which is so close as to <br />constitute an immediate hazard. <br />Proceeding past such sign with resultant <br />collision or other interference with traffic <br />on the intersecting street shall be deemed <br />prima facie in violation of this regulation. <br />A motorist proceeding against the "YIELD <br />RIGHT OF WAY" sign, therefore must keep his <br />vehicle under control to the extent that he <br />is prepared to yield or give way to the <br />driver or drivers approaching either from <br />the right or left on the intersecting street, <br />and must be prepared to come to a stop if <br />necessary in order to yield this right of <br />way. <br />SECTION II: This Ordinance shall be in full force and effect from and after <br />its adoption by the Common Council, approval by the Mayor and legal publicat <br />the <br />
