LEASE <br />THIS LEASE (the or this "Lease ") is made by and between the City of South Bend, Indiana, Department of <br />Redevelopment, acting by and through the South Bend Redevelopment Commission, (the "Landlord ") and Michiana <br />Brewer's Supply, LLC, an Indiana limited liability company (the "Tenant') as of the date of last execution hereof by <br />Landlord or Tenant (the "Effective Date "). <br />WITNESSETH: <br />ARTICLE I. <br />BASIC LEASE PROVISIONS <br />1.1. Basic Lease Provisions. The following basic provisions of this Lease (the `Basic Lease <br />Provisions ") constitute an integral part of this Lease and are set forth in this Section 1.1 for the convenience of the <br />parties. Each reference in this Lease to a Basic Lease Provision shall be construed to incorporate all of the terms <br />provided for under such provisions. <br />(a) Leased Premises: Defined in Section 2.1 hereof, consisting of <br />approximately 1,106 square feet of "Floor Area." <br />(b) Term: Initial Term of Three (3) Lease Years and Six (6) <br />Months, with One (1) option of Three (3) Lease Years to <br />extend the Initial Term, all as provided for in Sections <br />3.1 and 3.2 hereof. <br />(c) Tenant's Use Retail Sales of Equipment and higredients for Brewing <br />Beer. <br />(d) Tenant's Trade Name: Michiana Brewer's Supply (or such other trade name <br />taken by the Tenant) <br />(e) Landlord's Address: 1400 S County -City Building <br />227 West Jefferson Boulevard <br />South Bend, hidiana 46601 <br />(f) Tenant's Address: Aaron Goldstein <br />657 Ostemo Pl. <br />South Bend, hidiana 46617 <br />Facsimile Number: <br />(g) Lease Year: A "Lease Year" shall mean each period of twelve (12) <br />consecutive full months, beginning on the <br />Commencement Date as defined in Section 3.1 (such <br />that if the Commencement Date is not the first day of a <br />calendar month, then the first Lease Year shall begin on <br />the first day of the first calendar month following the <br />Commencement Date, and any partial month in which <br />the Commencement Date occurs will be included within <br />the first Lease Year). <br />(h) Security Deposit: An amount equal to the first month's Initial Term <br />Modified Gross Rent as security deposit shall be due <br />upon signing of lease. <br />
