(Western Avenue) from Maple Street east to 0. 02 mile east of Taylor <br />Street in South Bend, In diana, and <br />WHEREAS, the total estimated construction cost of the project <br />is $71, 700. 00, and <br />WHEREAS, the City's share of the cost shall be 50% of the total <br />amount of the entire final construction cost of said project and the <br />City has, by an appropriation duly made and entered of record, appro- <br />priated the sum of $35, 850. 00 to apply to the cost of said project, which <br />amount is estimated to equal the City's share of the entire cost of the <br />project. <br />IT IS THEREFORE AGREED by and between the Department and the <br />City as follows: <br />1. The plans and specifications for the proposed project shall be <br />prepared by the Department, which plans and specifications shall <br />be completed and ready for the letting of the contract not later <br />than day of , 19_ <br />2. The plans and specifications shall be subject to the approval <br />of the City. In the event that said plans and specifications are <br />duly approved by said City, the Department shall, within a <br />reasonable time, in accordance with the laws and regulations <br />governing the letting of contracts by said Department, advertise <br />for bids, and. upon receipt and approval of an acceptable pro- <br />posal, the Department shall award a construction contract there- <br />fore under the laws and regulations governing said Department. <br />The construction contract shallnot be let for a price in excess <br />of the Engineer's Estimate. <br />3. Before the awarding of the construction contract and before the <br />beginning of the work thereunder, the City shall contribute and <br />pay to the State, through the State Highway Department, a sum <br />equal to 50% of the bid price for construction; and, upon the <br />completion of the contract, the City shall pay to the State, <br />through said Department, the remaining part of the portion of the <br />cost for which the City is liable under the terms of this agree- <br />ment. The City's portion of the construction cost is 50110 of the <br />total payment to the contractor. It is understood that the con- <br />struction contract is to be awarded on unit prices, on estimated <br />quantities, and if the total paymentto the contractor under the <br />construction contract is more or less than that estimated at the <br />time of signing the construction contract, the City's portion of <br />the cost shall increase or decrease accordingly. In no case <br />shall the City pay to the State less than 501a of the cost of <br />the construction contract work. Changes in the construction con- <br />tract will not be made without approval of Raymond S. Andrysiak, <br />City Engineer of South Bend, or his duly authorized successor. <br />
