or municipal purposes during such ownership and said real <br />estate was and is no longer used or useful for municipal <br />purposes; and <br />WHEREAS, a college, viz: The Trustees of Indiana <br />University, a body politic, owned and still owns a campus <br />adjacent to the real estate hereinafter described, and which <br />college receives financial support from the State of Indiana <br />and the County in which the same is situated; and <br />WHEREAS, it is the intent of the Common Council of <br />the Municipal City of South Bend to make unmistakably clear <br />that all interest of the Municipal City of South Bend and its <br />Park Department and /or Board of Park Commissioners has validly <br />been granted and conveyed in fee to said college, viz: The <br />Trustees of Indiana University, a body politic, subject to <br />the reservation hereinafter provided. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council <br />of the (Civil) Municipal City of South Bend, Indiana: <br />1. That said Council does hereby ratify, confirm <br />and approve the deed of the Mayor of the City of South Bend, <br />St, Joseph County, Indiana, to The Trustees of Indiana Universi- <br />ty, a body politic, in the State of Indiana, recorded April <br />12, 1957, in Deed Record 5651 pages 453 -455, of the office <br />of the Recorder of St, Joseph County, Indiana, executed under <br />and pursuant to the authority of Chapter 72, page 178, of the <br />Acts of the General Assembly of the State of Indiana of 1951, (all <br />without the necessity of otherwise complying with any other <br />statute relating to sales of public lands by municipal corpor- <br />ations as provided in said Chapter 72 of said Acts), and under <br />the authority of Ordinance No. 4097, entitled "An Ordinance <br />authorizing the transfer and conveyance of vacant property on <br />Northside Boulevard owned by the City of South Bend for the <br />use of its Park Department to The Board of Trustees of Indiana <br />University in accordance with the Acts of the General Assembly <br />-2- <br />
