Substitute Bill No. 17 -14 <br />Responsible Animal and Pet Ownership Care and Control Regulation Ordinance <br />Page 24 <br />(3) To tether or confine a dog at aTaearn an unattended structure or premises for any purpose <br />when it is not monitored by an adult owner or guardian who is present at the property for <br />the duration of such tethering or confinement. <br />(4) To tether a dog under six (6) months of age. <br />(5) For more than three (3) dogs to be tethered simultaneously at the same residence. <br />(6) To have contact between tethered dogs. <br />(7.) For tethered dogs to be within three feet (3') of another person's property, public <br />thoroughfare, and /or right -of -way. <br />(8.) To tether a dog without access to adequate shelter at all times. <br />(e) Multiple tangling during tethering. If one (1) or more dogs at a residence have required a <br />response from the Division of Animal Care and Control to untangle tethers more than two (2) times in <br />one year, it shall be a violation of this Section. <br />See. 5 -23 Cruelty to Animals Prohibited?? <br />(a) No person shall beat, cruelly treat, neglect, torment, overload, overwork, or <br />otherwise abuse any animal except that reasonable force may be employed to drive off vicious or <br />trespassing animals. <br />(b) No animal shall be left unattended in a vehicle when the conditions in that vehicle <br />would constitute a health hazard to the animal. C,...aitis ,; inel de but , - <br />(c) No person shall transport any animal in an imenclosed truck bed or open <br />portion of any vehicle unless the animals is enclosed in a cage which is securely fastened to the vehicle. <br />See. 5 -24 Animal Hoarding Prohibited. <br />It shall be a violation of this section to be an Animal Hoarder as defined in Section 5 -2 of this Chapter. <br />27 Indiana Code § 3546 -3 -0.5 defines "abandon, beat, mutilate, neglect, and torture" of an animal. Versions A and B of <br />Indiana Code § 3546 -12 addresses the torture or mutilation of a vertebrate animal. Versions A and B of Indiana Code § 35- <br />46 -12.5 address domestic violence animal cruelty. <br />
