5 <br />The Petitioners would state that the proposed use will not be <br />injurious to the public health, safety, comfort, community moral <br />standards, convenience or general welfare. The proposed Gasoline Service <br />Station should be an added convenience for patrons using the facility. <br />The Petitioners would state that the proposed use will not injure or <br />adversely affect the use of the adjacent area or property values <br />therein. The proposed Gasoline Service Station is small in size and fits <br />with the existing Convenience store. The gas pumps are secondary to the <br />primary use of the property which are items sold in the Convenience <br />store. With the proposed new fence screening and landscaping, values on <br />adjacent properties should not be adversely affected. The Petitioners <br />would state that the proposed use will be consistent with the character <br />of the district in which it is located and the land uses authorized <br />therein. The combination of the existing Convenience store with the <br />addition of the gas pumps is in keeping in character with of the <br />district and the surrounding neighborhood. The Petitioners would state <br />that the proposed use is not specifically shown with the recommendations <br />of the City of South Bend Comprehensive Plan. The City Comprehensive <br />plan shows that this portion of Elwood Avenue is appropriate for <br />Commercial (Office & Retail) node with low & medium density residential <br />development. The Petitioners believe the proposed combination <br />Convenience store with gas pumps would provide added services to the <br />existing residential uses. <br />The Petitioners would ask the Board Members to agree that approval of <br />the above described Variances and Special Exception requests will not <br />have a detrimental affect for this area, nor would the property values, <br />public's health, safety, morals, or general welfare be adversely <br />affected. <br />The Petitioners contend that the strict application of the terms of <br />the Zoning ordinance will constitute an unusual and unnecessary hardship <br />as applied to the property for which the Variances and Special Exception <br />are sought: that the need for the Variances and Special Exception arises <br />from such condition peculiar to the property in the same Zone: and that <br />the use or value of the area adjacent to the property described in the <br />Petition for the Variances and Special Exception will not be injurious <br />to the public health, Safety, morals, or general welfare of the <br />community. <br />I attest, under the penalties for perjury, that the foregoing <br />representations are true. <br />Michael J.
