ORDINANCE NO, tt 10, E � I DE PAR "* Fy^,�n? x iil Z AN ORDINANCE AUTHORIZING THE CITY CONi'i ' OF THE CITY OF SOUTH BEND, INDIANA, TO MAKE A rOAN OF $30, 000.00 FROM THE STATE OF INDIANA, OR OTHER GOVERNMENT AGENCY$ FOR THE PURPOSE OF MAKING A SEWER SURVEY OF THE CITY OF SOUTH BEND, INDIANA, 9--j R�� WHEREAS, the City of South Bend, Indiana, by and through its Board of Public Works and Safety, desires to make survey studies of the sewer system in the City of South Bend, Indiana, and WHEREASs the sewers of the City of South Bend are a combined sanitary and storm water system, and WHEREASs during severe storms there are areas that flood, and WHEREASs the remaining capacity of these sewers should be re- served and protected for more sanitary flow and less storm water, and WHEREAS, a survey is deemed necessary to ascertain the remedial construction steps to be taken and to rate these construction projects as to priority, so that the most critical areas can be given relief first, and WHEREAS, the Department of Public Works and Safety of the City of South Bend, is without sufficient funds to pay the costs of such surveys, and WHEREAS, there is now available from the State of Indiana certain loan funds for the purpose of paying the costs of repairing and making such sur- veys, and WHEREAS, application has been made by the City of South Bend to borrow the funds necessary for the making of such surveys. NOWT THEREFORE: BE IT ORDAINED by the Common Council of the Civil City of South Bend, Indiana, as follows: SECTION I: The City Controller is hereby authorized and empowered to negotiate a loan from the State of Indiana, or the proper loan agency for a period of not to exceed three (3) years, and said City Controller is hereby authorized to execute such loan warrants or other evidences of indebtedness that may be necessary to secure said loan, fa�^r Q ��pl 30, �. o-u LAPP �' SECTI,ON II: The proceeds of said loan shall be credited to the account of the Board of Public Works and Safety - Current Obligations Account No, 630, Payment of Trnav4wwamy Loans, for the purpose of paying for the costs of said survey studies of the sewer system of the City of South Bend. SECTION III; This ordinance shall be in full force and effect from and after its passage by the Common Council, its approval by the Mayor ..and the fulfillment of all statutory requirements of this State.
