Dear Council Members: I hereby Certify that the above referenced ordinance of APC Initiated was legally advertised on Thursday, April 03, 2014 and that the Area Plan Commission at its public hearing on Tuesday, April 15, 2014 took the following action: Upon a motion by John DeLee, being seconded by Michelle Hektor and unanimously carried, the Ordinance initiated by the Area Plan Commission on behalf of the the Common Council of the City of South Bend, Indiana, Amending Chapter 21 of the South Bend Municipal Code, Article 4, Industrial Districts to exclude uses already permitted as a primary use from the Special Exception Use subsection; and modifying Article 6, Overlay and Special Use Districts, to add a new subsection relative to the applicability of the Northeast Neighborhood Development Area Overlay Zoning District to Planned Unit Developments, is sent to the Common Council with a favorable recommendation. The text amendments address certain changes that are necessary and practical to revise and clarify various sections of the South Bend Zoning Ordinance. PLEASE NOTE that the Ordinance has been amended by the petitioner and is different than that used for the Common Council's first reading. The amended Ordinance was legally advertised and heard by the Area Plan Commission. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded- teyevata- later -dateade a part of this report.
