ORDINANCE NO. I ~ - ~~ <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY <br />CONTIGUOUS THEREWITH LOCATED IN GERMAN TOWNSHIP, ST. JOSEPH <br />COUNTY, INDIANA (STASZEWSKI ANNEXATION) AND <br />CHANGING ZONING DESIGNATION <br />The Common Council of the City of South Bend, Indiana has determined that it is in the <br />best interest of the City of South Bend to annex and bring within the corporate limits of the City <br />of South Bend certain territory that is contiguous with the City of South Bend. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, as follows: <br />SECTION I. The following described real estate situated in St. Joseph County, <br />Indiana, having approximately 70% of its aggregate external boundaries contiguous with the <br />present boundaries of the City of South Bend, Indiana, shall be and hereby is annexed to and <br />brought within the City of South Bend, Indiana. This property contains approximately 0.5 acres <br />and its general boundaries are the East side of Olive Road, approximately 1,300 feet north of <br />Cleveland Road, having a more specific legal description as follows: <br />A parcel of land being in the Southwest Quarter of Section 19, Township 38 -- <br />North, Range 2 East, German Township, St. Joseph County, Indiana and being <br />more particularly described as follows: <br />Commencing at the southwest corner of Section 19, Township 38 North, Range 2 <br />east; thence Northerly 2,855.36 feet to a point, said point being the intersection of <br />the Westerly line of said section and the centerline of the Indiana East-West Toll <br />Road; thence Easterly along the centerline of said Toll Road 1,019.36 feet to a <br />point, said point being the intersection of Olive Road and said Toll Road; thence <br />Southerly along the centerline of Olive Road 1,416.28 feet; thence Easterly 20 <br />feet to the easterly right-of--way line of Olive Road and place of beginning; thence <br />Easterly 180 feet to a point; thence Southerly 120 feet to a point; thence Westerly <br />180 feet to a point; thence Northerly 120 feet to the point and place of beginning. <br />SECTION II. The above-described real estate is needed and can be used by the City for <br />its development in the reasonably near future. <br />SECTION III. The boundaries of the City of South Bend, Indiana, shall be and hereby <br />are declared to be extended so as to include all of the above-described real estate as a part of the <br />City of South Bend, Indiana. <br />SECTION IV. The zoning classification of the annexation area described in Section I <br />shall be and hereby is designated as `D" Light Industrial; "A" Height and Area, pursuant to the <br />
