ORDINANCE NO. <br />AN ORDINANCE AUTHORIZING THE RECEIPT OF <br />REALA ND PERSONAL PROPERTY KNOWN AS THE <br />PALACE THEATRE PROPERTY FROM THE E. M. <br />MORRIS FOUNDATION, INC. <br />WHEREAS the E. M. Morris Foundation, Inc. has signified its <br />willingness to make a gift to the Civil City of South Bend of all its right, title <br />and interest in and to a certain tract of improved real estate in the City of <br />South Bend, St. Joseph County, Indiana, described as follows: <br />Lot Number 4 and 42 feet off the North side of Lot <br />Number 5 as shown on the Original Plat of the Town, <br />now City, of South Bend, with a frontage on Michigan <br />Street in said City of approximately 108 feet and a <br />depth of approximately 165 feet, <br />together with the furniture, furnishings and fixtures therein contained, which <br />is now generally known as the Palace Theatre property, such property to be <br />used by said City for exclusively public purposes, to provide the residents of <br />South Bend and the surrounding territory an auditorium for lectures, legitimate <br />theater presentations, symphony concerts and other civic and educational pur- <br />poses; and <br />WHEREAS such property will be of great benefit to the City of <br />South Bend and will serve the social and cultural welfare of the residents of <br />South Bend and the surrounding community; and <br />WHEREAS the Civil City of South Bend should, in the interests of <br />public welfare, accept such gift; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON <br />COUNCIL of the City of South Bend: <br />SECTION I. That the Civil City of South Bend will accept the gift of the <br />E. M. Morris Foundation, Inc. of all its right, title and interest in and to <br />
