AND NORTHERN INDIANA TRANSIT, INC.. ITS SUC- THE RATE WHEREAS, heretofore, to wit: on the ,�13 day of February, 1962, the City of South Bend, Indiana, acting by and through its Board of Public Works and Safety, entered into the following contract with Northern Indiana Transit, Inc.: CONTRACT THIS CONTRACT, made and entered into this day of February, 1962, by and between the CITY OF SOUTH BEND, INDIANA, acting by and through its Board of Public Works and Safety, hereinafter called the First Party, and NORTHERN INDIANA TRANSIT, INC. , a corporation organized under the laws of the State of Indiana, its successors and assigns, hereinafter called the Second Party, WITNESSETH- The parties hereto agree that the certain contract made between the parties on or about May 13, 1940 and thereafter confirmed by Ordinance of the Common Council of the City of South Bend, and as subsequently further amended and confirmed by Ordinances of the Common Council of the City of South Bend, the last amendment by contract dated January 30, 1958, and con- firmed by Ordinance of the said Council, shall be and is hereby amended in each of the following respects: All provisions in said Contract, as amended, regarding token fares shall be eliminated, and said provisions relating to cash fares shall remain as in said amended Contract provided, to wit:
