ORDINANCE NO. ? AN ORDINANCE AMENDING SECTION 24, OF CHAPTER 30, OF ORDINANCE NO. 3709, APPROVED JULY 12, 1949, COMMONLY KNOWN" AS "MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1949 ", ALSO KNOWN AS ORDINANCE NO. 3423, SECTION 21. BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I. That Section 24, of Chapter 30, of Ordinance No. 3709, approved July 12, 1949, and commonly known as the "Municipal Code of the City of South Bend, Indiana, 1949 ", also known as Ordinance No. 3423, Section 21, be and the same hereby is amended to read as follows: SECTION 24. Arborists to obtain license; application; approval of board; license fee; period of validity; revocation. It shall be unlawful for any person, firm or corporation to engage in the business of planting, removing, trimming or spraying trees or shrubs within the corporate limits of the city without first obtaining an annual license, auth- orizing such person, firm or corporation to engage in such business. Each applicant for such a license shall procure from the City Controller an applica- tion for such license. No license shall be issued by the City Controller until the above mentioned application has been approved by the board and such approval will not be granted unless the board is satisfied of the competency of the applicant to engage in such business. Before a license is issued the appli- cant shall be required to file with the City Controller a Certificate of Insurance as proof that the licensee is carrying public liability insurance in an amount of not less than $25, 000. 00 for each person, $50, 000. 00 each accident, and property damage insurance in an amount of not less than $5, 000. 00 for each accident. Such proof of insurance to be filed each year before an annual license is granted. Insurance shall expire at the end of each year. Upon recommendation of the board and proof of insurance the City Con- troller shall issue a license to such arborist upon payment of the following fees: (a) For engaging in such business, the sum of Ten ($10. 00) Dollars per year. (b) For each vehicle used in conducting the business, the sum of fifty ($. 50�) cents per year, for which numbered license plates shall be issued. Upon payment of the fee and the issuance of such license by the City Controller, the applicant shall be entitled to conduct such business during the calendar year within which the license is issued.
