I ~ ' AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21, ARTICLE 6, DIVISION 2, EXCEPTIONS TO DISTRICT REGULATIONS, OF THE SOUTH BEND MUNICIPAL CODE TO ALLOW CERTAIN TYPES OF MANUFACTURING RETAILERS IN THE "A-3" MIXED USE MULTIFAMILY RESIDENTIAL AND COMMERCIAL DISTRICT STATEMENT OF PURPOSE AND INTENT The purpose of this ordinance is to amend Chapter 21 of the South Bend Municipal Code to allow certain types of manufacturing retailers as Special Exceptions in the "A- 3" Mixed Use Multifamily Residential and Commercial District. The Common Council of the City of South Bend recognizes its duty to enact zoning ordinances to promote the general health, welfare and safety of residents of the City of South Bend. Now, Therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: follows: section: Section I. Chapter 21, Article 6, Section 21-117.01 - 22-117.04 Reserved be amended as Section 21-117.01 - 21-117:84 .03 Reserved Section II. Chapter 21, Article 6, Section 21-117 be amended by adding the following Sec. 21-117.04 Exception in the "A-3" Mixed Use Multifamily Residential and Commercial District. (al The following exception may be permitted in the "A-3" Mixed Use Multifamily Residential and Commercial District. 11 Manufacturing retailers such as confectioners,_bakeries, brewpubs where food or beverage products are sold_on the same_premises where they are produced, provided that the Zoning Board of Appeals and the Common Council determine that the use will further the Citv's goal of making the downtown and East Bank area a regional entertainment and tourist center. Section III.
