SECTION II. The City of South Bend hereby reserves the rights <br />and easements of all utilities and the Municipal City of South <br />Bend, Indiana, to construct and maintain any facilities, including, <br />but not limited to, the following: electric, telephone, gas, <br />water, sewer, surface water control structures and ditches, within <br />the vacated right-of-way, unless such rights are released by the <br />individual utilities. <br />SECTION III. The following property may be injuriously or <br />beneficially affected by such vacating: <br />LOT NUMBER 18-3007-0236 <br />LOT NUMBER 18-3007-0239 <br />LOT NUMBER 18-3007-0242 <br />SECTION IV. The purpose of the vacation of the real property <br />is the maximization of security at the Robert A. Grant Federal <br />Building & U.S. Courthouse. <br />SECTION V. This ordinance shall be subject to the first <br />condition set forth in a letter dated November 13, 2000 from the <br />Board of Public Works which is on file in the Office of the City <br />Clerk. Said ordinance shall be further subject to the filing of <br />written agreement(s) addressing ingress and egress between the <br />petitioner and the property owners of the properties with key <br />numbers <br />18-3007-0236 18-3007-0249 <br />18-3007-0239 18-3007-0247 <br />18-3007-0242 18-3007-0248 <br />with the City Clerk on or before December 13, 2000, and all such <br />agreements being duly recorded in the St. Joseph County Recorder's <br />Office. <br />SECTION VI.
