ROOM 1 140 <br />COUNTY-CITY BLDG. <br />SOUTH BEND, INDIANA 4"0-1 (574) 235 - 9571 <br />Wednesday, April 16, 2014 <br />Sw� k <br />�l � \ <br />0, - <br />2-'t <br />The Honorable Council of the City of South Bend <br />4th Floor, County-City Building <br />South Bend, IN 46601 <br />RE: An Ordinance initiated by the Area Plan Commission on behalf of the the Common Council of the City of <br />South Bend, Indiana, Amending Chapter 21 of the South Bend Municipal Code, Article 4, Industrial Districts <br />to exclude uses already permitted as a primary use from the Special Exception Use subsection; and modifying <br />Article 6, Overlay and Special Use Districts, to add a new subsection relative to the applicability of the <br />Northeast Neighborhood Development Area Overlay Zoning District to Planned Unit Developments. - APC# <br />2701 -14. <br />Dear Council Members: <br />I hereby Certify that the above referenced ordinance of APC Initiated was legally advertised on Thursday, April <br />03, 2014 and that the Area Plan Commission at its public hearing on Tuesday, April 15, 2014 took the following <br />action: <br />Upon a motion by John DeLee, being seconded by Michelle Hektor and unanimously carried, the <br />Ordinance initiated by the Area Plan Commission on behalf of the the Common Council of the City of <br />South Bend, Indiana, Amending Chapter 21 of the South Bend Municipal Code, Article 4, Industrial <br />Districts to exclude uses already permitted as a primary use from the Special Exception Use <br />subsection; and modifying Article 6, Overlay and Special Use Districts, to add a new subsection <br />relative to the applicability of the Northeast Neighborhood Development Area Overlay Zoning District <br />to Planned Unit Developments, is sent to the Common Council with a favorable recommendation. The <br />text amendments address certain changes that are necessary and practical to revise and clarify various <br />sections of the South Bend Zoning Ordinance. <br />PLEASE NOTE that the Ordinance has been amended by the petitioner and is different than that used for the <br />Common Council's first reading.
