ORDINANCE NO . 1 ~~ -O~ <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING ARTICLE 3, NONCONFORMING USES, OF CHAPTER 21, <br />ZONING, OF THE SOUTH BEND MUNICIPAL CODE BY REVISING AND ADDING <br />REGULATIONS TO ALLOW FOR RECONSTRUCTION OF NON-CONFORMING SINGLE- <br />FAMILY HOMES. <br />STATEMENT OF PURPOSE AND INTENT <br />The purpose of this ordinance is to amend Chapter 21 of the <br />Municipal Code to modify the nonconforming use regulations. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />Section 1. Section 21-37 of Article 3 Chapter 21 of the <br />South Bend Municipal Code is amended to read as follows: <br />Sec. 21-37 (c) <br />~e-ss -___--_`--' -___.. A nonconforming use or structure, <br />except a single-family dwelling and its accessory buildings, <br />which is destroyed or damaged by fire or other casualty or <br />act of God to the extent that the cost of restoration to the <br />condition in which it was before the occurrence will exceed <br />fifty percent (50o)of the cost of restoration of the <br />entire building or structure new, shall not be restored <br />unless said building or structure and the use thereof, <br />conforms to all regulations of the district in which it is <br />located. <br />(d) Whenever a nonconforming use of a building has been <br />changed to a more restricted use or to a conforming use, <br />such use shall not thereafter be changed to a less <br />restricted use. <br />
