ORDINANCE NO . 1 ~~ -O~ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING ARTICLE 3, NONCONFORMING USES, OF CHAPTER 21, ZONING, OF THE SOUTH BEND MUNICIPAL CODE BY REVISING AND ADDING REGULATIONS TO ALLOW FOR RECONSTRUCTION OF NON-CONFORMING SINGLE- FAMILY HOMES. STATEMENT OF PURPOSE AND INTENT The purpose of this ordinance is to amend Chapter 21 of the Municipal Code to modify the nonconforming use regulations. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section 1. Section 21-37 of Article 3 Chapter 21 of the South Bend Municipal Code is amended to read as follows: Sec. 21-37 (c) ~e-ss -___--_`--' -___.. A nonconforming use or structure, except a single-family dwelling and its accessory buildings, which is destroyed or damaged by fire or other casualty or act of God to the extent that the cost of restoration to the condition in which it was before the occurrence will exceed fifty percent (50o)of the cost of restoration of the entire building or structure new, shall not be restored unless said building or structure and the use thereof, conforms to all regulations of the district in which it is located. (d) Whenever a nonconforming use of a building has been changed to a more restricted use or to a conforming use, such use shall not thereafter be changed to a less restricted use.
