BILL NO. ORDINANCE NO. ~' ~ ~ - ~~ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING VARIOUS SECTIONS WITHIN CHAPTER 21, ARTICLE 2, DIVISION 7, "C" COMMERCIAL DISTRICT REGULATIONS, OF THE SOUTH BEND MUNICIPAL CODE TO ADD ZONING DISTRICTS TO THE LOCATIONAL REQUIREMENTS OF ADULT USES STATEMENT OF PURPOSE AND INTENT The purpose of this ordinance is to amend Chapter 21 of the South Bend Municipal Code to add to the list of those use districts in which there is a distance restriction between adult businesses and these districts. The Common Council of the City of Soutli Bend recognizes its duty to enact zoning ordinances to promote the general health, welfare and safety of residents of the City of South Bend. The Common Council further recognizes that providing for an adequate amount of space between certain types of uses will promote the general health, welfare and safety, enhance the quality of life for the residents of the City of South Bend, and decrease the potential of blight and the disruption of the quiet enjoyment of commercial and residential property. Now, Therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: Section I. Chapter 21, Article 2, Division 7, Section 21-18 (d) (A) be amended by adding the following: (12) "IP" Industrial Park Section II. Chapter 21, Article 2, Division 7, Section 21-18 (d) (B) be amended by adding the following: (5) "A"Agricultural District (6) "O" Office District (7) "OB" OfficeBusiness District (8) "B"Business District Section VI. This Ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor.
