�J 1�. ORDINANCE NO. AN ORDINANCE AMENDING ORDINANCE NO. 4381 -61, AND COMMONLY KNOWN AS THE BUILDING CODE FOR THE CIVIL CITY OF SOUTH BEND, INDIANA BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I. That Section 1704. 1 shall be amended by the addition of the following, to -wit: Each Appliance Dealer and Class "D" Electrical Dealer shall keep a separate and complete record, showing each sale of a water heater and /or water softener. The record shall show date of sale, name of purchaser, address to which the appliance was delivered and /or installed; also type of appliance, serial number or other identifying number, and by whom installed. This record shall be available for examination by the Commissioner of the Building Department or anyone in his Department who he may delegate upon request by such Commissioner, to examine said records at any time during regular business hours. SECTION II. That Section 1704. 73 be amended to read as follows: 1704.73 Appliance Dealer. - An Appliance Dealer, within the meaning of this code, shall be any person who offers for sale to the general public, water heaters, water softeners, or both; who shall maintain a shop or store as an outlet for the sale of such fix- tures and appliances who contracts for the installation of water softeners and water heaters in one and two - family dwellings only; and who shall be licensed by the City as herein required, Provided, however, a Person, Firm or Corporation holding a Class "D" Electrical Dealers License under Ordinance No. 3913, as amended, who may sell but does not actually install any such water softeners or electric water heaters through persons directly employed by them as licensed Appliance Installers shall not constitute an Appliance Dealer within the meaning of this Code, and further provided that if the contract of sale of any such electric water heater or water softener requires installation, the Class "D" Electrical Dealer shall either employ the services of a licensed master plumber and licensed electrical contractor to make such installation or shall sub- contract the installation of such water heater or water softener with a licensed Appliance Dealer.
