REGULAR MEETING SEPTEMBER 8, 2008 <br />Councilmember Varner made a motion to continue this bill until the September 22, 2008 meeting <br />of the Council at the request of the petitioner. Councilmember Puzzello seconded the motion <br />which carried by a voice vote of nine (9) ayes. <br /> <br />BILL NO. 53-08 PUBLIC HEARING ON A BILL FIXING MAXIMUM <br /> SALARIES AND WAGES OF APPOINTED OFFICERS <br /> AND NON-BARGAINING EMPLOYEES OF THE CITY <br /> OF SOUTH BEND, INDIANA, FOR THE CALENDAR <br /> YEAR 2009 <br /> <br />nd <br />Councilmember Varner made a motion to accept the 2 substitute version of this bill. <br />Councilmember Oliver Davis seconded the motion which carried by a voice vote of nine (9) <br />ayes. <br /> <br />Councilmember Varner, Vice-Chairperson, Personnel & Finance Committee, reported that this <br />committee held a Public Hearing on this bill this afternoon and sends it to the full Council with <br />no recommendation due to the lack of a quorum. <br /> <br />th <br />Catherine Fanello, City Controller, 12 Floor County-City Building, 227 W. Jefferson Blvd., <br />South Bend, Indiana, made the presentation for this bill. <br /> <br />Ms. Fanello advised that this bill sets the maximum salaries for all non-bargaining personnel. <br />This bill reflects a 2% increase over 2008 salaries, which will not be funded if the city receives <br />no new additional revenue to mitigate the effects of the 2009 property tax reform. But the bill <br />will allow the city to set a maximum in order to have flexibility in case such additional revenue <br />does become available. Ms. Fanello further advised that it is important to note that any <br />positions/ titles marked new have been funded through existing dollars and no new dollars are <br />st <br />requested. She indicated that the 1 substitute bill added item (h) Early Retirement Incentives; <br />the new position of Assistant Facility Maintenance Manager should read Assistance Facility <br />Operations Manager; added title Director of Finance (Public Works); and Custodian is also noted <br />as just for the Morris Performing Arts Center. Ms. Fanello advised that the second substitute <br />deletes in item E performance incentives. Item G it deletes the words department heads and <br />inserts city employees and adds an added section on cell phone allowance for city employees. <br />Ms. Fanello reiterated that none of the mentioned positions were funded with new money, but <br />through the reorganization of current positions. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill, Councilmember Puzzello made a motion for favorable recommendation to full Council <br />concerning this bill. Councilmember White, seconded the motion which carried by a voice vote <br />of nine (9) ayes. <br /> <br /> <br />BILL NO. 54-08 PUBLIC HEARING ON A BILL OF THE COMMON <br /> COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA, APPROPRIATING $710,000.00 FROM THE <br /> PUBLIC WORKS SEWER GENERAL OPERATING <br /> FUND NO. 641 TO PAY COMPROMISE JUDGMENT <br /> <br />Councilmember Oliver Davis, Chairperson, Utilities Committee and Councilmember David <br />Varner, Chairperson, Public Works and Property Vacation Committee, reported that their <br />Committees held a joint Public Hearing on this bill this afternoon and voted to send it to the full <br />Council with a favorable recommendation. <br /> <br />th <br />Ms. Aladean DeRose, Chief Assistant City Attorney, 14 Floor County-City Building, 227 W. <br />Jefferson Blvd., South Bend, Indiana, made the presentation for this bill. <br /> <br />Ms. DeRose advised that on February 14, 2008, the St. Joseph Superior Court entered a <br />judgment against the City of South Bend in the sum of $614,725.64.
