ORDINANCE NO. Sm <br />AN ORDINANCE AMENDING CHAPTER 32, SECTION 1 OF <br />ORDINANCE NO. 4608 -63, BEING THE MUNICIPAL CODE <br />OF THE CITY OF SOUTH BEND, INDIANA, 1962, REDEFINING <br />THE TERM. "RESTAURANT ". <br />BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA: <br />SECTION I. That Chapter 32, Section 1 of the Municipal Code of the <br />City of South Bend, Indiana, 1962, be amended by redefining the term <br />"Restaurants" so that it reads as follows: <br />"Restaurants ". Any restaurant, coffee shop, cafeteria, <br />short -order cafe, luncheonette, tavern, sandwich stand, soda fountain, <br />drive -in restaurant, drive -in theater restaurant, in -plant food service, <br />commissary, snack bar, food catering or food establishment, whether <br />fixed or movable, where food for human consumption is prepared or <br />served in such manner that it is ready for consumption on the premises. <br />The term "restaurant" shall not include a food establishment that is <br />known as a retail food market where food is not prepared and served <br />for consumption on the premises; nor shall the term "restaurant" <br />include any coin - operated vending machine dispensing any kind or <br />type of food, confectionery or beverage ". <br />SECTION II.
