PUBLIC WORKS & PROPERTY VACATION MARCH 24, 2014 4:00 P.M. <br />Committee Members Present: Henry Davis, Dr. Fred Ferlic, Tim Scott, Valerie Schey <br />Other Council Present: Dr. David Varner, Oliver Davis, Karen White, Gavin Ferlic, <br />Derek Dieter, Kathy Cekanski - Farrand, John Voorde <br />Others Present: Kathryn Roos, Scott Ford, Cecil Eastman, Brian Moll, <br />Carol Davis, Tom Nimtz <br />Agenda: Bill No. 22 -14 Alley Vacation E/W Alley South of Vine Street <br />Vice -Chair Tim Scott began the Public Works & Property Vacation Committee promptly at 4:00 P.M. with <br />one item on the agenda. The Chair, Henry Davis was 2 minutes tardy; but acquiesced to Tim to chair the <br />hearing. <br />Up for consideration was Bill No. 22 -14 a request to vacate the 1't E/W alley South of Vine Street from <br />20th Street for a distance of 133.5 ft. <br />Brian Moll of American Structurepoint represented the petitioner, Kyle Bach. Mr. Bach is the CEO of <br />Annex of South Bend LLC, the company renovating nearby high -rise apartment buildings. <br />Mr. Moll made a brief presentation, indicating the Board of Public Works had reviewed the petition <br />before sending it to Council with a favorable recommendation. <br />During the public portion two people spoke against the petition. <br />Mr. Tom Nimtz of 1010 21't Street said the vacation would create an inconvenience for nearby residents <br />and a hazard due to increased student traffic from IUSB. <br />Carol Davis said she agreed, having delivered newspapers in the area for years. <br />In the Council portion Derek Dieter and Karen White each asked if the petitioner had met with nearby <br />residents. Mr. Moll said the petitioner did not. Karen said meeting with all stakeholders, including <br />nearby IUSB, was necessary if a collection "buy in" was to be achieved. <br />Facing this significant opposition, Mr. Moll apologized to Council, promised to work for neighborhood <br />consensus and asked for a continuation until the April 28th meeting of the Council. <br />Valerie Schey so moves, Fred Ferlic seconded and all agrees to continue on the 28th of April. <br />Tim Scott adjourned at 4:10 P.M. <br />
