C ~ ~ Z~ RESOLUTION NO. 2513 A RESOLUTION OF THE SOUTH BEND REUGVELOPI\1ENT COMMISSION RELATED TO ACQUISITION OF PROPERTY' IN "1'HE AIRPOR'T' ECONOMIC DEVELOPMENT AREA WHEREAS, under the authority granted by Indiana Code ~ 36-7-14. e! secy. and in fin~therance of the Airport Economic Deselopment Area Plan ("Pfan~), the South Bend Rcde~clopmcnt Commission ("Commission~~) has determined that it is necessary to acquire unencumbered fee simple interest in certain property located ~s~ithin the area heretofore designated as the Airport Economic Des~dopmcnt Area (the "Area~~) within the City of South Bcnd, Indiana (the °City~~). which property is more particularly described at Exhibit A attached hereto and incorporated herein ("Propertc~~): and WHEREAS, on June 1 ~. 20t)~. the Commission adopted Resolution No. ?455 amending the Plan and adding the Property to the Areas acquisition list and WHEREAS, t~s~o (2) independent appraisals of the Property have been obtained in accordance with Indiana Code ~ ~6 7-14 I9(b). ~~~hich provide an offering price of S35,750.00 (the °Oiferin~~ Pricc'~1: and 1VHEREAS, the Commission no~~~ desires to authorize its authorized agents.. hired for such purposes. or the staff of the Commission to pro~~ide and negotiate an offer for the Pw~ehase of the Property in accordance ~~~ith Indiana Code ~ 36-7-14-19. which may include relocation costs and the Commission's payment o! expenses incidental to the conveyance and determination oi~the title of the Property; and ~~'HEREAS, the Commission finds that all procedures necessary for authorizing and acquiring the Property hav c been completed in accordance ~~~ith Indiana l a~~ NO\V', THEREFORE, BE IT RESOLVED by the South Bcnd Redc~clopmcnt Commission that: 1 . Authorized agents of the Commission and the staff of the Commission are hereby authorized and directed to cause a purchase offer to be made in ~~~riting to the o~~~ncr(s) oi' the Property as described at Exhibit A at the Offering Price (the ".A~era~ae Acquisition Price" in L:xhihit A) in accordance ~~~ith Indiana Code ~ ~6-7- 14-19. which offer or process mass include relocation costs and the payment of expenses incidental to the u~meyance and determination of the title of the Propert}°. ?.
