FILED IN CLI <br />Q�C <br />KATHRYN <br />CITY CLERK, "Y.7 <br />2nd READING <br />TTEE OF THE <br />'rrLIC HEARING <br />3:d REAUM <br />MT VPR ®YE® <br />REFERRED <br />PASSED <br />mij <br />IJ �ry <br />BLOUGH ORDINANCE NO. 4824 -65 <br />I BEND, IND— AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF <br />A GIFT OF PROPERTY TO BE DONATED BY INDIANA <br />& MICHIGAN ELECTRIC COMPANY TO THE MUNICIPAL <br />CITY OF SOUTH BEND, INDIANA <br />BE IT ORDAINED by the Common Council of the Municipal <br />City of South Bend, Indiana: <br />SECTION I: That the offer of Indiana & Michigan Electric <br />Company to give and donate to the Municipal City of South Bend, <br />Indiana exclusively for public purposes the dam across the St. <br />Joseph River in the North West Quarter (u) of Section No. 12, Town- <br />ship No. 37 North, Range No. 2 East, in the City of South Bend, St. <br />Joseph County, Indiana, together with the Hydro Electric Power <br />House and certain real estate and rights adjacent thereto as more <br />particularly described in the form of quit -claim deed and instru- <br />ment entitled "Agreement Accepting Gift" tendered for consideration <br />by the Common Council of the Municipal City of South Bend, Indiana <br />is in the public interests and that said offer and gift of said <br />property subject to the exceptions, reservations, covenants, agree- <br />ments and terms contained in said form of quit -claim deed and in- <br />strument entitled "Agreement Accepting Gift" is hereby accepted <br />on behalf of the Municipal City of South Bend, Indiana. <br />SECTION II: That the Mayor and City Clerk of the <br />Municipal City of South Bend, Indiana are authorized, empowered and <br />directed to execute and deliver said "Agreement Accepting Gift" and <br />to accept and record said quit -claim deed in order that all of the <br />exceptions, reservations, covenants, agreements and terms thereof <br />will be binding upon the Municipal City of South Bend, Indiana. <br />SECTION III: That this ordinance shall be in full force <br />and effect from and after its adoption by the Common Council and <br />its approval by the Mayor. <br />•�_ / -G. <br />t •; <br />Mem er o Co n Counci <br />
