RESOLUTION NO. 2482 A RESOLUTION OF T[[E SOUTH 6ENll REDE1'ELOPMENT CONIIV91SS1ON RELATED TO ACQUISITION OF PROPERTY IN THG SOU'CH BEND CENTRAL DEVELOP~IEN"C AREA l~%IIEREAS. under the aulhority~rantcd by Indiana Code j 36-7-14. el sey. and in furtherance of the South Bend Ccnh al Dc~~clopmcnt urea Plan (`Plane). the South Bend Redevelopment Commission ('~Connnission~~) has determined that it is necessary to acquire unencumbered fee simple interest in certain propcrtics located ~-vithin the area heretofore designated as the South Bend Central De~~clopmcnt Area (the ".nrea~~) ~~~ithin the City of South Bend, Indiana (the "Cit~~~). ~~~hich properties are more particularly dcscribcd at Exhibit A attached hereto and incorporated herein (the "Propertics~~): and WH;=REAS. on Mardi ?8. ?008. the Commission adopted Res<~lution No. ?441 amending the Plan and adding the propcrtics to the nrea~s acyuisition list: and WHEREAS. t~~~o (?) independent appraisals of the propcrtics ha~~c been obtained in accordance ~~ ith Indiana ('ode ~ ~6-7- 14-19(h). ~e°hich pro~~ide the oticrin~a prices described ,it I.~hihit .A 1d~c'~Oflcrin~~ Price~~): and WHEREAS, the Commission no~~ desires to authorize the staff of the Commission to proridc and negotiate an offer for the Purchase of the propcrtics in accordance with Indiana Code ~ ~G-7-1=3 19. ~~hich may include the acquisition of an option and the Conu»ission~s pa~mcnt of cspcnses incidental to the com~c~ancc and determination of the title of the propcrtics: and WHEREAS, the Commission finds that all procedures necessary for authorizing and acquiring the propcrtics have been completed in accordance ~~~ith Indiana la~~~; NOw'. THEREFORE. BE Il~ RESOLVED by the South Bend Rcdevclopmcnt Commission That: 1 . The state of the Commission arc hcrebv authorized and directed to cause a purchase offer to be nuuic in writing to the o~~°ner(s) of the Properties as dcscribcd at Exhibit A at the Oftcring Price (the ";1~cra~~c ~~cyuisition Price~~ in I-:~hibit ~1) in accordance Frith Indiana Code ~ ~6-7 14-19, ~~~hich offer or process may include the acquisition of an option for the lxuchase price and the payment of expenses incidental to the com~cyancc and determination of the title of the propcrtics. ?. ~I~hc Commission's atwrnc~ is hcrcb< authorized and directed to nc~~otiatc and prepare documentation necessary to accomplish the acquisition of the Properties in accordance ~~~ith this Resolution and in a form acceptable to Icgal counsel.
