RESOLUTION N0. 2481 A RESOLUTION OF THE SOUTH 6END REDEVELOPMENT C0~~1J11SSION RELATF,D TO ACQUISITION OF PROPERTI" IN THE SOUTH BEND CENTRAL DEVELOPI~9GN"f AREA WHEREAS. under the authority granted by lndiana Code ~ i6 7-14, et sey. and in furtherance of the South Bend Central De~~elopment Area Plan ('~Plan~). the South Bend Redevelopment Commission ("Commission") has determined that it is necessary to acquire unencumbered fee simple interest in certain properties located within the urea hcretot~n~c dcsi~~natcd as the South E3end Central Development Area (the °Area~~) within the City of South Bend, Indiana (the "Citv~~), which properties arc more particularly described at Exhibit A attached hereto and incorporated herein (the "Properties°); and WHEREAS. on March ?~. ?005. the Commission adopted Resolution V'o. ?441 amending the Plan and adding the Properties to the Areas acquisition list; and WHEREAS, two (2) independent appraisals of the Properties have been obtained in accordance with Indiana Code ~ 3G 7-14-19fb), which provide the offering prices described at Exhibit A (the ~-Offerin~a pricc~~)_ and WHEREAS, the Commission no~~ desires to authorise the staff of the Commission to provide and negotiate an offa~ for the Purchase of the Properties in accordance with Indiana Code ~ 3G 7-14-19, which may include the acquisition of an option and the Commissions payment of expenses incidental to the amvc~ance and determination of the title of the Properties: and WHEREAS, the Commission finds that all procedures necessary fr~r authorizing and acquirin~a the properties have been completed in accordance ~~ith Indiana la~~~, NOW. THEREFORE. BE 1T RESOLVED by the South Bend Ralevclopment Commission that I . The staff of the Commission arc hcrebv authorized and directed to cause a purchase offer to be made in e~~riting to the owner(s) oC the Properties as described at Exhibit A at the Offering Price (the ":1~cra~ae Acquisition Price~~ in lahibit ~y) in accordance ~~~ith Indiana Code ~ ~6-7-14 19. which offer or process may include the acquisition of an option tier the purchase price and the payment of expenses incidental to the con~~eyance and determination of the title of the Properties. ?. The Commissions attorney is hcreh~ authorized and directed to nc~,otiatc and prepare documentation necessary to accomplish the acquisition of the Properties in accordance with this Resolution and in a fiorm acceptable to Iegal counsel.
